(1) Penalty Per Count. The Department is authorized to find that grounds exist under Florida Statutes § 717.1322, for disciplinary action based upon a single act, transaction or occurrence of misconduct by a person. “”Penalty per count”” means the total of the stated penalties in a count for each act, transaction or occurrence in violation of the Florida Disposition of Unclaimed Property Act, chapter 717, F.S.
    (2) Total Penalty. Each penalty per count shall be added together and the sum shall be referred to as the “”total penalty.””
    (3) Final Penalty. The final penalty means the penalty which will be imposed against a person under these rules, as adjusted to take into consideration aggravating or mitigating factors, if any.
