(1) In accordance with Florida Statutes § 456.073(3), and Florida Statutes § 120.695, when a complaint is received, the Department shall issue a notice of noncompliance as a first response to a minor violation of a rule. Failure of a licensee to take action in correcting the violation within the 15 days after notice may result in either the issuance of a citation when appropriate or the institution of regular disciplinary proceedings. “”Minor violations”” as used in sections 456.073(3), and 120.695, F.S., are defined as follows:
