(a) If a candidate changes their name within one year of any election, the new name shall not appear upon the ballot unless the change was made by either of the following:

(1) Marriage.

Terms Used In California Elections Code 13104

  • candidate: includes any officeholder who is subject to a recall election. See California Elections Code 305
  • Election: means any election including a primary that is provided for under this code. See California Elections Code 318
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

(2) Decree of any court of competent jurisdiction.

(b) This section does not apply to candidates for the offices of President and Vice President of the United States.
