(a) The Cullman County Commission shall create the Cullman County Legislative Delegation Fund.

Terms Used In Alabama Code 45-22-190

  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: means next after. See Alabama Code 1-1-1
  • year: means a calendar year; but, whenever the word "year" is used in reference to any appropriations for the payment of money out of the treasury, it shall mean fiscal year. See Alabama Code 1-1-1
(b) The fund shall be comprised of the following monies received by the county:

(1) The additional three percent of TVA in-lieu-of-taxes payments received pursuant to Section 40-28-2.
(2) Any other monies provided for by law.
(c) The commission shall immediately pay amounts from the fund as the Cullman County Legislative Delegation may request.
(d) The legislative delegation shall expend the monies on allowable public purposes at the discretion and direction of the legislative delegation.
(e) All decisions concerning the Cullman County Legislative Delegation Fund shall be made by resolutions adopted by the members of the Cullman County Legislative Delegation.
(f) Any funds allocated but not spent at the end of the fiscal year shall not be applied for any other purpose, but shall be carried forward and shall remain available year to year for expenditure as provided in this section.
(g) The revenue and expenditures of the legislative delegation office shall be audited on an annual basis.
