Terms Used In Illinois Compiled Statutes > 10 ILCS 5 - Election Code

  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Ballot: means paper ballot sheets. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Ballot: means an electronic audio or video display or any other medium, including paper, used to record a voter's choices for the candidates of their preference and for or against public questions. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • Ballot card: means a ballot which is voted by the process of punching. See Illinois Compiled Statutes 10 ILCS 5/24A-2
  • Ballot configuration: means the particular combination of political subdivision ballots including, for each political subdivision, the particular combination of offices, candidate names and questions as it appears for each group of voters who may cast the same ballot.   • Ballot sheet: means a paper ballot printed on one or both sides which is (1) designed and prepared so that the voter may indicate his or her votes in designated areas, which must be areas clearly printed or otherwise delineated for such purpose, and (2) capable of having votes marked in the designated areas automatically examined, counted, and tabulated by an electronic scanning process.   • Ballot sheet: means a paper ballot printed on one or both sides which is (1) designed and prepared so that the voter may indicate his or her votes in designated areas, which must be enclosed areas clearly printed or otherwise delineated for such purpose, and (2) capable of having votes marked in the designated areas automatically examined, counted, and tabulated by an electronic scanning process.   • Board: means the State Board of Elections. See Illinois Compiled Statutes 10 ILCS 5/12A-2
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • Central counting: means the counting of ballots in one or more locations selected by the election authority for the processing or counting, or both, of ballots. See Illinois Compiled Statutes 10 ILCS 5/24B-2

  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Computer operator: means any person or persons designated by the election authority to operate the automatic tabulating equipment during any portion of the vote tallying process in an election, but shall not include judges of election operating vote tabulating equipment in the precinct.   • Department: means the Illinois Department of Revenue. See Illinois Compiled Statutes 20 ILCS 2510/2510-5
  • Dependent: A person dependent for support upon another.
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Edit listing: means a computer generated listing of the names of each candidate and public question as they appear in the program for each precinct. See Illinois Compiled Statutes 10 ILCS 5/24C-2

  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.

  • political party: as used in this article shall mean a political party which, at the next preceding election for governor, polled at least five per cent of the entire vote cast in the State; Provided, that no political organization or group shall be qualified as a political party hereunder, or given a place on a ballot, which organization or group is associated, directly or indirectly, with Communist, Fascist, Nazi or other un-American principles and engages in activities or propaganda designed to teach subservience to the political principles and ideals of foreign nations or the overthrow by violence of the established constitutional form of government of the United States and the State of Illinois.   • provisional voter: means a person claiming to be a registered voter who is entitled by Section 18A-5 of this Code to vote a provisional ballot under the following circumstances:
  •             (1) The person's name does not appear on the
            
    official list of eligible voters for the precinct in which the person seeks to vote and the person has refused an opportunity to register at the polling location or another grace period registration site. See Illinois Compiled Statutes 10 ILCS 5/18A-218.10
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.

  • Security punch: means a punch placed on a ballot card to identify to the computer program the offices and propositions for which votes may be cast and to indicate the manner in which votes cast should be tabulated while negating any inadmissible votes.   • Separate ballot: means a separate page or display screen of the ballot that is clearly defined and distinguishable from other portions of the ballot. See Illinois Compiled Statutes 10 ILCS 5/24C-2
  • Special districts: has the meaning ascribed to that term in Article VII of the Constitution of the State of Illinois of 1970. See Illinois Compiled Statutes 5 ILCS 70/1.29
  • Specimen ballot: means a representation of names of offices and candidates and statements of measures to be voted on which will appear on the official ballot or marking device on election day. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Statewide candidate: means any candidate who runs for a statewide office, including Governor, Lieutenant Governor, Attorney General, Secretary of State, Treasurer, Comptroller, United States President, or United States Senator. See Illinois Compiled Statutes 10 ILCS 5/12A-2
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Summons: Another word for subpoena used by the criminal justice system.
  • system: means the total combination of mechanical, electromechanical or electronic equipment, programs and practices used to define ballots, cast and count votes, report or display election results, maintain or produce any audit trail information, identify all system components, test the system during development, maintenance and operation, maintain records of system errors and defects, determine specific system changes to be made to a system after initial qualification, and make available any materials to the voter such as notices, instructions, forms or paper ballots.   • Testify: Answer questions in court.
  • Township office: means an office elected by the

  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • Verdict: The decision of a petit jury or a judge.
  • Voting defect identification: means the capability to detect overvoted ballots or ballots which cannot be read by the automatic tabulating equipment. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Voting defects: means an overvoted ballot, or a ballot which cannot be read by the automatic tabulating equipment. See Illinois Compiled Statutes 10 ILCS 5/24B-2
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
