Terms Used In Illinois Compiled Statutes 740 ILCS 185/2.8

  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
Nothing in this Act limits the rights of a party to pursue causes of action under other laws, including any available common law remedies for damages. A plaintiff may bring an action and recover damages under any applicable Section of this Act; however, if more than one Section applies to a given wrongfully cut tree, the plaintiff may bring an action and recover damages under only one applicable Section of this Act.
