- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
The Secretary may summarily suspend the license of a nursing home administrator without a hearing, simultaneously with the institution of proceedings for a hearing provided under this Act if the Secretary finds that evidence in his or her possession indicates that a licensee’s continuation in practice would constitute an immediate danger to the public. If the Secretary summarily suspends the license without a hearing, a hearing shall be held within 30 calendar days after the suspension has occurred.
