Prior to his or her retirement under KRS § 16.510 to KRS § 16.652, any Department of Kentucky
State Police officer, as defined in KRS § 16.010, who became disabled on or before July 1,
1977, as a result of an injury or disease arising out of the performance of a hazardous duty in the course of his or her employment with the department may elect benefits under KRS
16.165, if he or she qualifies therefor, or he or she may elect to continue receiving preretirement benefits otherwise available to him or her due to the disability.
