(1) Local legislative bodies shall have all the powers necessary to carry out the purposes and provisions of KRS § 65.410 to KRS § 65.460, including the following powers in addition to others granted by KRS § 65.410 to KRS § 65.460:

Terms Used In Kentucky Statutes 65.440

  • Action: includes all proceedings in any court of this state. See Kentucky Statutes 446.010
  • Contract: A legal written agreement that becomes binding when signed.
  • Federal: refers to the United States. See Kentucky Statutes 446.010
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Personal property: All property that is not real property.
  • public funds: means sums actually received in cash or negotiable instruments from all sources unless otherwise described by any state agency, state- owned corporation, university, department, cabinet, fiduciary for the benefit of any form of state organization, authority, board, bureau, interstate compact, commission, committee, conference, council, office, or any other form of organization whether or not the money has ever been paid into the Treasury and whether or not the money is still in the Treasury if the money is controlled by any form of state organization, except for those funds the management of which is to be reported to the Legislative Research Commission pursuant to KRS §. See Kentucky Statutes 446.010
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • State: when applied to a part of the United States, includes territories, outlying possessions, and the District of Columbia. See Kentucky Statutes 446.010

KRS § 65.410 to KRS § 65.460;
(b) To advance or accept advances of public funds;
(c) To apply for, accept and utilize grants and any other assistance from the federal government and any other public or private sources; to give such security as may be required and to enter and carry out contracts or agreements in connection with the assistance; and to include in any contract for assistance from the federal government such conditions imposed pursuant to federal laws as the local legislative body may deem reasonable and appropriate and which are not inconsistent with the purposes of KRS § 65.410 to KRS § 65.460;
(d) To make and execute contracts and other instruments necessary to the exercise of its powers under KRS § 65.410 to KRS § 65.460;
(e) In connection with the real property acquired for the purposes of KRS § 65.410 to KRS § 65.460, to provide or to arrange or contract for the provision, construction, maintenance, operation or repair by any person or agency, public or private, of services, privileges, works, streets, roads, public utilities, or other facilities or structures that may be necessary to the provision, preservation, maintenance, and management of the property as open space land;
(f) To insure or provide for the insurance of any real or personal property or operations of the public body against any risks or hazards, including the power to pay premiums on the insurance;
(g) To demolish or dispose of any structures or facilities which may be detrimental to or inconsistent with the use of real property as open space land; and
(h) To exercise any or all of its functions and powers under KRS § 65.410 to KRS § 65.460 jointly or cooperatively with one or more public bodies of this state, and to enter into agreements for joint or cooperative action.
(2) For the purposes of KRS § 65.410 to KRS § 65.460 the local legislative bodies may: (a) Appropriate funds;
(b) Issue and sell their revenue bonds and general obligation bonds in the manner and within the limitations prescribed by the applicable laws of the Commonwealth; and
(c) Exercise their powers under KRS § 65.410 to KRS § 65.460 through a board or commission, or through such office or officers as the local legislative bodies by resolution determine.
