Any holder of bonds issued under the provisions of KRS § 177.390 to KRS § 177.570 or any of the coupons appertaining thereto, and the trustee under any trust agreement, except to the extent the rights herein given may be restricted by such trust agreement, may, either at law or in equity, by suit, action, mandamus or other proceeding, protect and enforce any and all rights under the laws of the Commonwealth or granted under KRS § 177.390 to
177.570 or under such trust agreement or the proceedings authorizing the issuance of such bonds, and may enforce and compel the performance of all duties required by KRS
177.390 to 177.570 or by such trust agreement or proceedings to be performed by the department or by any officer or employee thereof, including the fixing, charging and collecting of tolls.
