(1) A licensee whose license has been revoked may petition the board for reinstatement.
The board shall investigate the petition and may reinstate the license upon finding that the individual has complied with any terms prescribed by the board and is again able to engage in the practice of fitting hearing instruments.
(2) A licensee or applicant aggrieved by an order of the board refusing, suspending, or revoking a license may within thirty (30) days after notice thereof appeal thereupon to the Franklin Circuit Court. The appeal shall be determined by the court upon the certified record and no new or additional evidence shall be heard or considered by the court. Either party aggrieved by a final order entered by the court may appeal to the Court of Appeals as in a civil action.

Terms Used In Kentucky Statutes 334.180
- Action: includes all proceedings in any court of this state. See Kentucky Statutes 446.010
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- License: means a license issued by the board under this chapter to specialists in hearing instruments. See Kentucky Statutes 334.010
- Practice of fitting hearing instruments: means the measurement of human hearing by means of an audiometer for the purpose of making selections, adaptions, and adjustments of hearing instruments, including both over-the-counter hearing aids and prescription hearing aids. See Kentucky Statutes 334.010
