(1) The records of the Department of Workers’ Claims, to the extent that they provide information personally identifying an individual alleging a work-related injury or occupational disease, shall not be open to the public but only to parties satisfying the commissioner of their interest in the records and their right to inspect them.
(2) This section shall not prohibit or limit the exchange of public records or the sharing of information between the Department of Workers’ Claims and another public agency when the exchange is serving a legitimate governmental need or is necessary in the performance of a legitimate government function, including the investigation of workers’ compensation fraud.

Terms Used In Kentucky Statutes 342.229
- Commissioner: means the commissioner of the Department of Workers' Claims under the direction and supervision of the secretary of the Education and Labor Cabinet. See Kentucky Statutes 342.0011
- Compensation: means all payments made under the provisions of this chapter representing the sum of income benefits and medical and related benefits. See Kentucky Statutes 342.0011
- Department: means the Department of Workers' Claims in the Education and
Labor Cabinet. See Kentucky Statutes 342.0011 - Fraud: Intentional deception resulting in injury to another.
- Injury: when used generally, unless the context indicates otherwise, shall include an occupational disease and damage to a prosthetic appliance, but shall not include a psychological, psychiatric, or stress-related change in the human organism, unless it is a direct result of a physical injury. - Occupational disease: means a disease arising out of and in the course of the employment. See Kentucky Statutes 342.0011
