Kentucky Statutes 393A.210 – Burden of proof to establish administrator’s right to custody

If the administrator asserts a right to custody of unclaimed property, the administrator has the burden to prove:
(1) The existence and amount of the property;
(2) The property shall be presumed abandoned; and
(3) The property shall be subject to the custody of the administrator.

- Administrator: means the Kentucky State Treasurer. See Kentucky Statutes 393A.010
