Terms Used In Texas Alcoholic Beverage Code 1.09

  • Brewer: means a person engaged in the brewing of malt beverages, whether located inside or outside the state. See Texas Alcoholic Beverage Code 1.04
  • Malt beverage: means a fermented beverage of any name or description containing one-half of one percent or more of alcohol by volume, brewed or produced from malt, in whole or in part, or from any malt substitute. See Texas Alcoholic Beverage Code 1.04

A reference in this code to:
(1) “Ale,” “beer,” or “malt liquor” means a malt beverage.
(2) “Brewer’s permit” or “manufacturer’s license” means a brewer‘s license.
(3) “Nonresident brewer’s permit” or “nonresident manufacturer’s license” means a nonresident brewer’s license.
(4) “Wine and beer retailer’s off-premise permit” means a wine and malt beverage retailer’s off-premise permit.
(5) “Wine and beer retailer’s permit” means a wine and malt beverage retailer’s permit.
