(a) Except as provided by § 130.002(b) or (c) or § 130.0021, this chapter does not apply to an owner of an interest in real property or persons employed solely by that owner.
(b) Except as provided by § 130.002(b) or (c) or § 130.0021, this chapter does not prohibit or make void or unenforceable a covenant or promise to:
(1) indemnify or hold harmless an owner of an interest in real property and persons employed solely by that owner; or
(2) allocate, release, liquidate, limit, or exclude liability in connection with a construction contract between an owner or other person for whom a construction contract is being performed and a registered architect or licensed engineer.
Terms Used In Texas Civil Practice and Remedies Code 130.004
- Contract: A legal written agreement that becomes binding when signed.
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Property: means real and personal property. See Texas Government Code 311.005
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
