(a) In this article, “identifying information” includes information that:
(1) reveals the identity, personal history, or background of a person; or
(2) concerns the victimization of a person.
(b) A communication or record is confidential for purposes of § 552.101, Government Code, if the communication or record:
(1) contains identifying information regarding a victim who receives a forensic medical examination under Article 56A.303; and
(2) is created by, provided to, or in the control or possession of the department.
