(a) The corporation shall purchase from a member association under conservatorship an interest in the association’s assets at a price agreed to by the conservator and the board, regardless of whether the price exceeds the market value of the purchased assets.
(b) A purchase must be made on the terms the board determines. The commissioner must approve the terms of the purchase in writing.

  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • in writing: includes any representation of words, letters, or figures, whether by writing, printing, or other means. See Texas Government Code 312.011
