Texas Government Code 526.0155 – Use of Fund in General; Rules for Allocation
(a) Except as otherwise provided by the terms of a waiver authorized by § 526.0152, money in the fund may be used:
(1) subject to § 526.0156, to provide to health care providers reimbursements that:
(A) are based on the providers’ costs related to providing uncompensated care; and
(B) compensate the providers for at least a portion of those costs;
(2) to reduce the number of individuals in this state who do not have health benefits coverage;
(3) to reduce the need for uncompensated health care provided by hospitals in this state; and
(4) for any other purpose specified by this subchapter or the waiver.
(b) On approval of the waiver authorized by § 526.0152, the executive commissioner shall:
(1) seek input from a broad base of stakeholder representatives on the development of rules with respect to and for the administration of the fund; and
(2) by rule develop a methodology for allocating money in the fund that is consistent with the terms of the waiver.
