Terms Used In Texas Government Code 540.0653

- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
If a Medicaid managed care organization fails to comply with one or more provider access standards the commission establishes under § 540.0652 and the commission determines the organization has not made substantial efforts to mitigate or remedy the noncompliance, the commission:
(1) may:
(A) elect to not retain or renew the commission’s contract with the organization; or
(B) require the organization to pay liquidated damages in accordance with § 540.0260(3); and
(2) if the organization’s noncompliance occurs in a given service delivery area for two consecutive calendar quarters, shall suspend default enrollment to the organization in that service delivery area for at least one calendar quarter.
