(a) If feasible, the executive commissioner by rule may establish an incentive payment program for nursing facilities that choose to participate. The program must be designed to improve the quality of care and services provided to recipients.
(b) Subject to § 546.0354, the incentive payment program may provide incentive payments in accordance with this section to encourage facilities to participate in the program.

- Contract: A legal written agreement that becomes binding when signed.
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Rule: includes regulation. See Texas Government Code 311.005
(c) The executive commissioner may:
(1) determine the amount of any incentive payment under the incentive payment program; and
(2) enter into a contract with a qualified person, as the executive commissioner determines, for the following services related to the program:
(A) data collection;
(B) data analysis; and
(C) technical support.
