(a) Subject to § 824.310, if a member has a total of less than 10 years of service credit in the retirement system on the date of disability retirement, the retirement system shall pay the person a disability retirement annuity of $150 a month for the shortest of the following periods:
(1) the duration of the disability;
(2) the number of months of creditable service the person has at retirement; or
(3) the duration of the person’s life.
(b) Subject to § 824.310, if a member has a total of at least 10 years of service credit in the retirement system on the date of disability retirement, the retirement system shall pay the person for the duration of the disability a disability retirement annuity in an amount equal to the greater of:
(1) a standard service retirement annuity computed under § 824.203; or
(2) $150 a month.

Terms Used In Texas Government Code 824.304

  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Month: means a calendar month. See Texas Government Code 312.011
  • Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005

(c) Before the 31st day after the date on which the medical board certifies a member’s disability, the member may reinstate withdrawn contributions and make deposits for military service and equivalent membership service and receive service credit as provided by this subtitle.
(d) The minimum benefits provided by this section are subject to reduction under rules adopted under § 824.310 and are also subject to reduction in the same manner as other benefits because of the selection of an optional retirement annuity.
