(a) A local government has the same power as the commission has under § 26.014 of this code to enter public and private property within its territorial jurisdiction to make inspections and investigations of conditions relating to water quality. The local government in exercising this power is subject to the same provisions and restrictions as the commission.
(b) When requested by the executive director, the result of any inspection or investigation made by the local government shall be transmitted to the commission for its consideration.

Terms Used In Texas Water Code 26.173

  • Commission: means the Texas Natural Resource Conservation Commission. See Texas Water Code 26.001
  • Executive director: means the executive director of the Texas Natural Resource Conservation Commission. See Texas Water Code 26.001
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Local government: means an incorporated city, a county, a river authority, or a water district or authority acting under Article III, § 52, or Article XVI, § 59 of the Texas Constitution. See Texas Water Code 26.001
  • Property: means real and personal property. See Texas Government Code 311.005
