(a) A report required or authorized under this subchapter and the identity of the person making the report are confidential and may not be disclosed except as provided by this section and § 301.414.
(b) The board may disclose the information to the same extent that the board may disclose information relating to a complaint under § 301.466.
Terms Used In Texas Occupations Code 301.417
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005

(d) In addition to the other authorizations of this section, the information may be disclosed in:
(1) a civil action in which a reporting person is named as a defendant as a result of making the report; or
(2) the prosecution of a cause of action based on a claim that the reporting person was subject to retaliatory action as a result of making the report.
