- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
- Written: includes any representation of words, letters, symbols, or figures. See Texas Government Code 311.005
If the executive council determines that a violation occurred, the executive council shall give written notice of the violation to the person alleged to have committed the violation. The notice may be given by certified mail. The notice must:
(1) include a brief summary of the alleged violation;
(2) state the amount of the administrative penalty recommended by the executive council; and
(3) inform the person of the person’s right to a hearing on the occurrence of the violation, the amount of the penalty, or both.
