A. The juvenile court shall have exclusive original jurisdiction over petitions to terminate the parent-child relationship when the child involved is present in this state.
Terms Used In Arizona Laws 8-532
- Child: means a person less than eighteen years of age. See Arizona Laws 8-531
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- juvenile: means an individual who is under eighteen years of age. See Arizona Laws 8-201
- Juvenile court: means the juvenile division of the superior court. See Arizona Laws 8-531
- legal custody: means a status embodying all of the following rights and responsibilities:
(a) The right to have physical possession of the child. See Arizona Laws 8-531
- Parent-child relationship: includes all rights, privileges, duties and obligations existing between parent and child, including inheritance rights. See Arizona Laws 8-531
B. The juvenile court shall continue to have exclusive original jurisdiction when the juvenile is in the legal custody of the juvenile court although the physical placement of the child is in another state pursuant to court order.
C. This article does not apply to termination proceedings conducted pursuant to article 11 of this chapter except to the extent prescribed in section 8-863.
