A. A motor carrier safety revolving fund is established consisting of monies appropriated to the fund by the legislature, monies deposited pursuant to this chapter and monies received from private grants or donations if so designated by the grantor or donor.

Terms Used In Arizona Laws 28-5203

  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Department: means the department of transportation acting directly or through its duly authorized officers and agents. See Arizona Laws 28-101
  • Director: means the director of the department of transportation. See Arizona Laws 28-101
  • Donor: The person who makes a gift.
  • Motor carrier: means a person who operates or causes to be operated a commercial motor vehicle on a public highway. See Arizona Laws 28-5201
  • Transportation: means a movement of person or property by a motor vehicle and any loading, unloading or storage incidental to the movement. See Arizona Laws 28-5201

B. Monies in the fund are a continuing appropriation to the department to be used by the department, the attorney general and the department of public safety to carry out this chapter. The director shall distribute monies in the fund.

C. The director of the department of transportation shall make a full accounting of the use of the fund to the director of the department of administration annually or as required by the director of the department of administration.

D. The motor carrier safety revolving fund is exempt from the provisions of section 35-190 relating to lapsing of appropriations.
