A. This state shall participate in the national low emission vehicle program adopted in Title 40 of the Code of Federal Regulations, Part 9, part 85 and part 86 effective March 9, 1998, as part of the long-term air quality strategy. The state shall not bear any of the administrative costs of the program. The state retains the authority to adopt any alternative emissions reduction program which demonstrates improved air quality benefits for the state.

- Vehicle: means any automobile, truck, truck tractor, motor bus or self-propelled or motor-driven vehicle registered or to be registered in this state and used upon the public highways of this state for the purpose of transporting persons or property, except implements of husbandry, road rollers or road machinery temporarily operated upon the highway. B. If this state does not participate in the program prescribed in subsection A, the state shall adopt the clean fuel fleets program prescribed in Title 40 of the Code of Federal Regulations, Part 88 for state, federal and political subdivision fleets in nonattainment areas.
