- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
In a jury trial, the court shall instruct the jury with regard to subdivisions (1) and (2) of N.C. Gen. Stat. § 1D-35 (1995, c. 514, s. 1.)
