North Carolina General Statutes 7A-450.1. Responsibility for payment by certain fiduciaries
Terms Used In North Carolina General Statutes 7A-450.1
- Dependent: A person dependent for support upon another.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- property: shall include all property, both real and personal. See North Carolina General Statutes 12-3
- state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies. See North Carolina General Statutes 12-3
- Trustee: A person or institution holding and administering property in trust.
It is the intent of the General Assembly that, whenever possible, if an attorney or guardian ad litem is appointed pursuant to N.C. Gen. Stat. § 7A-451 for a person who is less than 18 years old or who is at least 18 years old but remains dependent on and domiciled with a parent or guardian, the parent, guardian, or any trustee in possession of funds or property for the benefit of the person, shall reimburse the State for the attorney or guardian ad litem fees, pursuant to the procedures established in N.C. Gen. Stat. § 7A-450.2 and N.C. Gen. Stat. § 7A-450.3 This section shall not apply in any case in which the person for whom an attorney or guardian ad litem is appointed prevails.
