As used in this Article, unless the context clearly requires otherwise, the following definitions apply:

Terms Used In North Carolina General Statutes 54B-266

  • Association: includes a State association or a federal association unless limited by use of the words "State" or "federal. See North Carolina General Statutes 54B-4
  • Association: means a savings and loan association and includes a State association or a federal association unless limited by use of the words "State" or "federal". See North Carolina General Statutes 54B-266
  • Branch office: means an office of an association other than its principal office which renders savings and loan services. See North Carolina General Statutes 54B-4
  • Federal association: means a corporation or association organized and operated under the provisions of federal law and regulation to conduct a savings and loan business. See North Carolina General Statutes 54B-4
  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
  • Out-of-state association: means an association chartered by any state other than this State and whose principal office is not within this State. See North Carolina General Statutes 54B-266
  • Principal office: means the office which houses the headquarters of an association. See North Carolina General Statutes 54B-4
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies. See North Carolina General Statutes 12-3
  • State association: means a corporation or association organized under this Chapter or its predecessor and operated under the provisions of this Chapter to conduct the savings and loan business; or a corporation organized under the provisions of the predecessors to this Chapter and operated under the provisions of this Chapter; or a corporation organized under the provisions of federal law and so converted as to be operated under the provisions of this Chapter.   • State association: means an association chartered under the laws of this State. See North Carolina General Statutes 54B-266
  • Supervisor: means the state association supervisor or equivalent state official having primary regulatory authority over an out-of-state association. See North Carolina General Statutes 54B-266

(2) “Association” means a savings and loan association and includes a State association or a federal association unless limited by use of the words “State” or “federal”.

(3) “Branch” means a full-service office of an association through which it renders a savings and loan service other than its principal office. An association may engage in any authorized function or service through an authorized branch office.

(4) “Commission” means the State Banking Commission.

(5) “Home state” means (i) as to a state association, the state which granted the association its charter, and (ii) as to a federal association, the state in which the association has its principal office.

(6) “Out-of-state association” means an association chartered by any state other than this State and whose principal office is not within this State.

(7) “State association” means an association chartered under the laws of this State.

(8) “Supervisor” means the state association supervisor or equivalent state official having primary regulatory authority over an out-of-state association. (1993, c. 191, s. 2; 2001-193, ss. 16, 17; 2004-203, s. 35(a).)
