Terms Used In North Carolina General Statutes 58-89A-76

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.

The Commissioner, by rule, may provide for the acceptance of an affidavit by a bonded, independent, and qualified assurance organization that has been approved by the Commissioner certifying the qualifications of a professional employer organization for licensing under this Article in lieu of the requirements of N.C. Gen. Stat. § 58-89A-40 through N.C. Gen. Stat. § 58-89A-60. A professional employer organization licensed under this section shall be exempt from the provisions of N.C. Gen. Stat. § 58-89A-70(c), (d), and (e). (2004-162, s. 1.)
