The Board of Certification, in accordance with the procedure set forth in Chapter 150B of the N.C. Gen. Stat. of North Carolina, may issue a reprimand to an operator, or suspend or revoke the certificate of an operator, when it finds any of the following:

(1) The operator has practiced fraud or deception.

Terms Used In North Carolina General Statutes 90A-26

  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
  • Fraud: Intentional deception resulting in injury to another.

(2) The operator failed to use reasonable care, judgment, knowledge, or ability in the performance of an operator’s duties.

(3) The operator is incompetent or unable to properly perform the duties of an operator.
