Terms Used In Iowa Code > Chapter 326 - Registration Reciprocity
- Applicant: means a person in whose name an application is filed for registration under the plan. See Iowa Code 326.3
- Apportionable vehicle: means any power unit that is used or intended for use in two or more member jurisdictions and that is used for the transportation of persons for hire or designed, used, or maintained primarily for the transportation of property if one of the following applies:(1) The power unit has two axles and a gross vehicle weight or registered gross vehicle weight in excess of twenty-six thousand pounds. See Iowa Code 326.3
- Apportioned vehicle: means an apportionable vehicle that has been registered under the plan. See Iowa Code 326.3
- Audit: means the physical examination of a registrant's operational records, including source documents, to verify the distances reported in the registrant's application for apportioned registration and the accuracy of the registrant's record-keeping system for its fleet. See Iowa Code 326.3
- axle: is a ny such assembly whether or not it is load-bearing only part of the time. See Iowa Code 326.3
- Base jurisdiction: means the member jurisdiction, selected in accordance with the plan, to which an applicant applies for apportioned registration under the plan or the member jurisdiction that issues apportioned registration to a registrant under the plan. See Iowa Code 326.3
- Cab card: means an evidence of registration, other than a plate, issued for an apportioned vehicle registered under the plan by the base jurisdiction and carried in or on the identified vehicle. See Iowa Code 326.3
- Contract: A legal written agreement that becomes binding when signed.
- Credentials: means the cab card and plate issued in accordance with the plan. See Iowa Code 326.3
- Days: means calendar days. See Iowa Code 322G.2
- Department: means the department of transportation. See Iowa Code 326.2
- Department: means the state department of transportation. See Iowa Code 321H.2
- Director: means the director of transportation or the director's designee. See Iowa Code 326.2
- Director: means the director of the department. See Iowa Code 321I.1
- Driver: means a person who operates a motor vehicle for the transportation of railroad workers in the motor vehicle on behalf of a railroad worker transportation company, whether the person is employed by the company for wages or drives for the company as an independent contractor. See Iowa Code 327F.39
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Fleet: means one or more apportionable vehicles designated by a registrant for distance reporting under the plan. See Iowa Code 326.3
- following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
- highway: means the entire width between property lines of every way or place of whatever nature when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular travel, except in public areas in which the boundary shall be thirty-three feet each side of the center line of the roadway. See Iowa Code 321I.1
- Internet: means the federated international system that is composed of allied electronic communication networks linked by telecommunication channels, that uses standardized protocols, and that facilitates electronic communication services, including but not limited to use of the world wide web; the transmission of electronic mail or messages; the transfer of files and data or other electronic information; and the transmission of voice, image, and video. See Iowa Code 4.1
- Jurisdiction: means a country or a state, province, territory, possession, or federal district of a country. See Iowa Code 326.3
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Lease: means a transaction evidenced by a written document in which a lessor vests exclusive possession, control, and responsibility for the operation of a vehicle in a lessee for a specific term. See Iowa Code 326.3
- Lessee: means any consumer who leases a motor vehicle for one year or more pursuant to a written lease agreement which provides that the lessee is responsible for repairs to the motor vehicle. See Iowa Code 322G.2
- Lessee: means a person that is authorized to have exclusive possession and control of a vehicle owned by another person under terms of a lease agreement. See Iowa Code 326.3
- Member jurisdiction: means a jurisdiction that has applied and has been approved for membership in the plan in accordance with the plan. See Iowa Code 326.3
- month: means a calendar month, and the word "year" and the abbreviation "A. See Iowa Code 4.1
- Motor vehicle: means a self-propelled vehicle purchased or leased in this state, except as provided in section 322G. See Iowa Code 322G.2
- Nonresident: means a person who is not a resident of this state. See Iowa Code 321I.1
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Operate: means to ride in or on, other than as a passenger, use, or control the operation of an all-terrain vehicle in any manner, whether or not the all-terrain vehicle is moving. See Iowa Code 321I.1
- Operational records: means source documents that evidence distance traveled by a fleet in each member jurisdiction, such as fuel reports, trip sheets, and driver logs, including those which may be generated through on-board devices and maintained electronically, as required by the audit procedures manual. See Iowa Code 326.3
- Operator: means a person who operates or is in actual physical control of an all-terrain vehicle. See Iowa Code 321I.1
- Owner: means a person, other than a lienholder, having the property right in or title to an all-terrain vehicle. See Iowa Code 321I.1
- Person: includes any individual, firm, corporation, partnership, joint adventure, or association, and the plural as well as the singular number. See Iowa Code 321H.2
- plan: means the registration reciprocity agreement among states of the United States, the District of Columbia, and provinces of Canada providing for payment of apportionable fees on the basis of total distance operated in all jurisdictions, in effect on January 1, 2011, or as later amended, published by international registration plan, inc. See Iowa Code 326.2
- Plate: means the license plate, including renewal decals, if any, issued for a vehicle registered under the plan by the base jurisdiction. See Iowa Code 326.3
- Power unit: means a motor vehicle as distinguished from a trailer, semitrailer, or auxiliary axle, but not including an automobile or a motorcycle. See Iowa Code 326.3
- Properly registered vehicle: means a vehicle which has been registered in full compliance with the laws of all jurisdictions in which it is intended to operate. See Iowa Code 326.3
- property: includes personal and real property. See Iowa Code 4.1
- Reciprocity: means the reciprocal grant by one jurisdiction of operating rights or privileges in properly registered vehicles registered by another jurisdiction, especially but not exclusively including privileges generally conferred by vehicle registration. See Iowa Code 326.3
- Recreational vehicle: means a vehicle used for personal pleasure or personal travel and not in connection with any commercial endeavor. See Iowa Code 326.3
- Registrant: means a person in whose name a properly registered vehicle is registered. See Iowa Code 326.3
- Registration fee: means the annual motor vehicle registration fee imposed pursuant to section 321. See Iowa Code 326.2
- Registration year: means the twelve-month period during which, under the laws of the base jurisdiction, the registration issued to a registrant by the base jurisdiction is valid. See Iowa Code 326.3
- Reporting period: means the period of twelve consecutive months immediately prior to July 1 of the calendar year immediately preceding the beginning of the registration year for which apportioned registration is sought. See Iowa Code 326.3
- road: include public bridges, and may be held equivalent to the words "county way" "county road" "common road" and "state road". See Iowa Code 4.1
- Roadway: means that portion of a highway improved, designed, or ordinarily used for vehicular travel. See Iowa Code 321I.1
- state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
- Total distance: means all distance, including that accrued on trip permits, operated by a fleet of apportioned vehicles in all member jurisdictions during the reporting period. See Iowa Code 326.3
- Trip permit: means a permit issued by a member jurisdiction in lieu of apportioned or full registration. See Iowa Code 326.3
- Truck: means a power unit designed, used, or maintained primarily for the transportation of property. See Iowa Code 326.3
- United States: includes all the states. See Iowa Code 4.1
- Vehicle: means any vehicle as defined in chapter 321. See Iowa Code 321H.2
- year: means twelve consecutive months. See Iowa Code 4.1
