Terms Used In Iowa Code > Chapter 459A - Open Feedlot Operations and Animal Truck Wash Facilities
- Animal: means the same as defined in section 459. See Iowa Code 459A.102
- Animal feeding operation: means the same as defined in section 459. See Iowa Code 459A.102
- Animal truck wash effluent: means a combination of manure, washwater-induced runoff, or other runoff derived from an animal truck wash facility, which may include solids. See Iowa Code 459A.102
- Animal truck wash effluent structure: means an impoundment which is part of an animal truck wash facility, if the primary function of the impoundment is to collect and store animal truck wash effluent. See Iowa Code 459A.102
- Animal truck wash facility: means an operation engaged in washing single-unit trucks, truck-tractors, semitrailers, or trailers used to transport animals. See Iowa Code 459A.102
- Animal unit: means the same as defined in section 459. See Iowa Code 459A.102
- Animal unit capacity: means a measurement used to determine the maximum number of animal units that may be maintained as part of an open feedlot operation. See Iowa Code 459A.102
- ASTM international: means the American society for testing and materials international. See Iowa Code 459A.102
- basin: means an impoundment which is part of an open feedlot operation, if the primary function of the impoundment is to collect and store settled open feedlot effluent. See Iowa Code 459A.102
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Child: includes child by adoption. See Iowa Code 4.1
- Commission: means the natural resource commission. See Iowa Code 462A.2
- Commission: means the environmental protection commission created pursuant to section 455A. See Iowa Code 459A.102
- Confinement feeding operation: means the same as defined in section 459. See Iowa Code 459A.102
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Department: means the department of natural resources. See Iowa Code 462A.2
- Department: means the department of natural resources. See Iowa Code 459A.102
- Dependent: A person dependent for support upon another.
- Designated area: means a known sinkhole, a cistern, an abandoned well, an unplugged agricultural drainage well, an agricultural drainage well surface inlet, a drinking water well, a designated wetland, or a water source. See Iowa Code 459A.102
- Designated wetland: means the same as defined in section 459. See Iowa Code 459A.102
- Effluent: means open feedlot effluent or animal truck wash effluent. See Iowa Code 459A.102
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Farm pond: means a body of water wholly on the lands of a single owner, or a group of joint owners, which does not have any connection with any public waters and which is less than ten surface acres. See Iowa Code 462A.2
- following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
- Formed animal truck wash effluent structure: means a covered or uncovered impoundment used to store effluent from an animal truck wash facility, which has walls and a floor constructed of concrete, concrete block, wood, steel, or similar materials. See Iowa Code 459A.102
- Grassed waterway: means a natural or constructed channel that is shaped or graded and established with suitable vegetation for the stable conveyance of surface water runoff. See Iowa Code 459A.102
- High-quality water resource: means the same as defined in section 459. See Iowa Code 459A.102
- Internet: means the federated international system that is composed of allied electronic communication networks linked by telecommunication channels, that uses standardized protocols, and that facilitates electronic communication services, including but not limited to use of the world wide web; the transmission of electronic mail or messages; the transfer of files and data or other electronic information; and the transmission of voice, image, and video. See Iowa Code 4.1
- Internet site: means a specific location on the internet that is determined by internet protocol numbers, by a domain name, or by both, including but not limited to domain names that use the designations ". See Iowa Code 4.1
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Karst terrain: means the same as defined in section 459. See Iowa Code 459A.102
- Livestock: includes but is not limited to an animal classified as an ostrich, rhea, or emu. See Iowa Code 4.1
- Management plan: means the document that states the goals and objectives of a specific protected water area which has been proposed for designation, the specific description of the area to be protected, land use agreements with property owners, the specific management programming considerations for the area, the in-depth project evaluations, analysis, justifications, and cost estimates, the proposed acquisition of fee title and conservation easements and other agreements, and the specific design and layout of facilities. See Iowa Code 462B.1
- Manure storage structure: means the same as defined in section 459. See Iowa Code 459A.102
- NPDES permit: means a permit issued by the department under the national pollutant discharge elimination system pursuant to the federal Water Pollution Control Act of 1972, 33 U. See Iowa Code 459A.102
- Open feedlot: means a lot, yard, corral, building, or other area used to house animals in conjunction with an open feedlot operation. See Iowa Code 459A.102
- Open feedlot effluent: means a combination of manure, precipitation-induced runoff, or other runoff from an open feedlot before its settleable solids have been removed. See Iowa Code 459A.102
- Open feedlot operation structure: means an open feedlot, settled open feedlot effluent basin, a solids settling facility, or an alternative technology system. See Iowa Code 459A.102
- operation: means an unroofed or partially roofed animal feeding operation if crop, vegetation, or forage growth or residue cover is not maintained as part of the animal feeding operation during the period that animals are confined in the animal feeding operation. See Iowa Code 459A.102
- Owner: means a person who holds legal or equitable title to any of the following:a. See Iowa Code 459A.102
- Owner: means a person, other than a lienholder, having the property right in or title to a motorboat or vessel. See Iowa Code 462A.2
- Person: means an individual, partnership, firm, corporation, or association. See Iowa Code 462A.2
- plan: means a plan which provides for the management of open feedlot effluent, or animal truck wash effluent, including the application of effluent as provided in section 459A. See Iowa Code 459A.102
- Privately owned lake: means any lake, located within the boundaries of this state and not subject to federal control covering navigation owned by an individual, group of individuals, or a nonprofit corporation and which is not open to the use of the general public but is used exclusively by the owners and their personal guests. See Iowa Code 462A.2
- Professional engineer: means the same as defined in section 459. See Iowa Code 459A.102
- property: includes personal and real property. See Iowa Code 4.1
- Research college: means an accredited public or private college or university, including but not limited to a university under the control of the state board of regents as provided in chapter 262, or a community college under the jurisdiction of a board of directors for a merged area as provided in chapter 260C, if the college or university performs research or experimental activities regarding animal agriculture or agronomy. See Iowa Code 459A.102
- Rule: includes "regulation". See Iowa Code 4.1
- Seasonal high-water table: means the seasonal high-water table as determined by a professional engineer pursuant to the following requirements:
a. See Iowa Code 459A.103- settled effluent: means a combination of manure, precipitation-induced runoff, or other runoff originating from an open feedlot after its settleable solids have been removed. See Iowa Code 459A.102
- Small animal feeding operation: means the same as defined in section 459. See Iowa Code 459A.102
- Small animal truck wash facility: means an animal truck wash facility, if all of the following apply:
a. See Iowa Code 459A.102- Solids: includes settleable solids and scraped solids. See Iowa Code 459A.102
- Solids settling facility: means a basin, terrace, diversion, or other structure or solids removal method which is part of an open feedlot operation and which is designed and operated to remove settleable solids from open feedlot effluent. See Iowa Code 459A.102
- state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
- Stockpile: means to store solids from any of the following:

a. See Iowa Code 459A.102- Unformed animal truck wash effluent structure: means a covered or uncovered impoundment used to store animal truck wash effluent, other than a formed animal truck wash effluent structure. See Iowa Code 459A.102
- United States: includes all the states. See Iowa Code 4.1
- Use: means to operate, navigate, or employ a vessel. See Iowa Code 462A.2
- Water of the state: means the same as defined in section 455B. See Iowa Code 459A.102
- Water source: means the same as defined in section 459. See Iowa Code 459A.102
- year: means twelve consecutive months. See Iowa Code 4.1
