Terms Used In Iowa Code 135G.13

  • Department: means the department of inspections, appeals, and licensing. See Iowa Code 154A.1

  • Licensee: means the holder of a license issued to operate a subacute care facility for persons with serious and persistent mental illness. See Iowa Code 135G.1
  • subacute care facility: means an institution, place, building, or agency with restricted means of egress providing subacute mental health services for a period exceeding twenty-four consecutive hours to persons in need of the services. See Iowa Code 135G.1
 Judicial review of the action of the department may be sought pursuant to the Iowa administrative procedure Act, chapter 17A. Notwithstanding chapter 17A, a petition for judicial review of the department‘s actions under this chapter may be filed in the district court of the county in which the related subacute care facility is located or is proposed to be located. The status of the petitioner or the licensee shall be preserved pending final disposition of the judicial review.
