The deed shall be presumptive evidence in all the courts of this state in all controversies and actions in relation to the rights of the purchaser, and the purchaser’s heirs or assigns, to the parcel conveyed, of the following facts:
 1. That the parcel conveyed was subject to taxes for the year or years stated in the deed.

Terms Used In Iowa Code 448.4

  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • deed: is a pplied to an instrument conveying lands, but does not imply a sealed instrument; and the words "bond" and "indenture" do not necessarily imply a seal, and the word "undertaking" means a promise or security in any form. See Iowa Code 4.1
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Sale: means any transfer, exchange, or barter, in any manner or by any means whatsoever, for a consideration, and includes and means all sales made by any person. See Iowa Code 453A.42
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • year: means twelve consecutive months. See Iowa Code 4.1
 2. That the taxes were not paid at any time before the sale.
 3. That the parcel conveyed had not been redeemed from the sale at the date of the deed.
 4. That the parcel had been listed and assessed.
 5. That the taxes were levied or set according to law.
 6. That the parcel was duly advertised for sale.
 7. That the parcel was sold as stated in the deed.
