- Accident: means an occurrence during the operation of an amusement ride that results in death or injury requiring immediate hospital admission. See Ohio Code 993.01
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Advisory council: means the advisory council on amusement ride safety created by section 993. See Ohio Code 993.01
- agriculture: includes farming; ranching; aquaculture; algaculture meaning the farming of algae; apiculture and related apicultural activities, production of honey, beeswax, honeycomb, and other related products; horticulture; viticulture, winemaking, and related activities; animal husbandry, including, but not limited to, the care and raising of livestock, equine, and fur-bearing animals; poultry husbandry and the production of poultry and poultry products; dairy production; the production of field crops, tobacco, fruits, vegetables, nursery stock, ornamental shrubs, ornamental trees, flowers, sod, or mushrooms; timber; pasturage; any combination of the foregoing; the processing, drying, storage, and marketing of agricultural products when those activities are conducted in conjunction with, but are secondary to, such husbandry or production; and any additions or modifications to the foregoing made by the director of agriculture by rule adopted in accordance with Chapter 119 of the Revised Code. See Ohio Code 1.61
- Amusement ride: includes carnival rides, bungee jumping facilities, and fair rides, but does not include passenger tramways as defined in section 4169. See Ohio Code 993.01
- Amusement ride operator: means any person causing the amusement ride to go, stop, or perform its function. See Ohio Code 993.01
- Another: when used to designate the owner of property which is the subject of an offense, includes not only natural persons but also every other owner of property. See Ohio Code 1.02
- Bungee jumping: means a fall or jump from a height by an individual who is attached to an elastic cord that prevents the individual from hitting the ground, water, or other solid, semi-solid, liquid, or elastic surface. See Ohio Code 993.01
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Contract: A legal written agreement that becomes binding when signed.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- First aid: means the one-time treatment or subsequent observation of scratches, cuts not requiring stitches, burns, splinters, and contusions or a diagnostic procedure, including examinations and x-rays, that does not ordinarily require medical treatment even though provided by a physician or other licensed professional personnel. See Ohio Code 993.01
- in writing: includes any representation of words, letters, symbols, or figures; this provision does not affect any law relating to signatures. See Ohio Code 1.59
- Inspection: includes a reinspection. See Ohio Code 993.01
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Maintenance: means the preservation and upkeep of an amusement ride for the purpose of maintaining its designed operational capability. See Ohio Code 993.01
- Operation: means the use or operation, or both, of an amusement ride with riders. See Ohio Code 993.01
- Owner: means any person who owns or leases and controls or manages the operation of an amusement ride, and includes individuals, partnerships, corporations, both profit and nonprofit, and the state and any of its political subdivisions and their departments or agencies. See Ohio Code 993.01
- Permanent amusement ride: means an amusement ride that is erected to remain a lasting part of the premises. See Ohio Code 993.01
- Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
- Private facility: means any facility that is accessible only to members of the facility and not accessible to the general public, even upon payment of a fee or charge, and that requires approval for membership by a membership committee representing the current members who have a policy requiring monetary payment to belong to the facility. See Ohio Code 993.01
- Reassembly: means the installation, erection, or reconstruction of the main mechanical, safety, electrical, or electronic components of an amusement ride following transportation or storage and prior to operation. See Ohio Code 993.01
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Repair: means to restore an amusement ride to a condition equal to or better than original design specifications. See Ohio Code 993.01
- Rider: means any person who sits, stands, or is otherwise conveyed or carried as a passenger on an amusement ride, but does not include employees or agents of the owner of the amusement ride. See Ohio Code 993.01
- Rule: includes regulation. See Ohio Code 1.59
- Safe operation: means , except as provided in section 993. See Ohio Code 993.01
- Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
- state: means the state of Ohio. See Ohio Code 1.59
- Temporary amusement ride: means an amusement ride that is relocated at least once per year with or without disassembly. See Ohio Code 993.01
- United States: includes all the states. See Ohio Code 1.59
