(A) Except as provided in division (B) of this section, a person who applies for a certificate as a foreperson of surface maintenance facilities at underground or surface mines shall be able to read and write the English language and shall have had at least three years’ actual practical experience in or around the surface maintenance facilities of underground or surface mines or the equivalent thereof in the judgment of the chief of the division of mineral resources management. Each applicant for examination shall pay a fee of ten dollars to the chief on the first day of the examination.

Terms Used In Ohio Code 1561.18

  • Another: when used to designate the owner of property which is the subject of an offense, includes not only natural persons but also every other owner of property. See Ohio Code 1.02
  • Foreperson: means the person designated to assist the mine foreperson in the immediate supervision of a portion or the whole of a mine or of the persons employed therein. See Ohio Code 1561.01
  • Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
  • state: means the state of Ohio. See Ohio Code 1.59

(B) The chief shall issue a certificate as a foreperson of surface maintenance facilities at underground or surface mines in accordance with Chapter 4796 of the Revised Code to an applicant if either of the following applies:

(1) The applicant holds a license or certificate in another state.

(2) The applicant has satisfactory work experience, a government certification, or a private certification as described in that chapter as a foreperson of surface maintenance facilities at underground or surface mines in a state that does not issue that license or certificate.

(C) Any money collected under this section shall be paid into the state treasury to the credit of the mining regulation and safety fund created in section 1513.30 of the Revised Code.
