- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Authority: means a land bank fast track authority created under section 15, section 23(4), or section 23(5). See Michigan Laws 124.753
- Casino: means a casino regulated by this state under the Michigan Gaming Control and Revenue Act, 1996 IL 1, MCL 432. See Michigan Laws 124.753
- Commission: means the suicide prevention commission created in section 3. See Michigan Laws 330.3001
- Commissioner: means the director. See Michigan Laws 500.102
- Community overdose review: means performing a series of individual overdose reviews to identify systematic barriers to innovative overdose prevention and intervention strategies for that community. See Michigan Laws 330.3023
- Contract: A legal written agreement that becomes binding when signed.
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- County authority: means a county land bank fast track authority created by a county foreclosing governmental unit under section 23(4). See Michigan Laws 124.753
- County health officer: means a local health officer as that term is defined in section 1105 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 330.3023
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Department: means the department of insurance and financial services. See Michigan Laws 500.102
- Department: means the department of labor and economic opportunity. See Michigan Laws 124.753
- Department: means the department of health and human services. See Michigan Laws 330.3001
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Drug: means that term as defined in section 7105 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 330.3023
- Drug overdose: means that term as defined in section 7403 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 330.3023
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Executive committee: means the executive committee described in section 5. See Michigan Laws 330.3001
- Fiduciary: A trustee, executor, or administrator.
- Foreclosing governmental unit: means that term as defined in section 78 of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 124.753
- Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
- Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
- Fund: means the land bank fast track fund created in section 18. See Michigan Laws 124.753
- Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
- Hospital: means that term as defined in section 20106 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 330.3023
- Identifying information: means any representation of information that permits the identity of an individual to whom the information applies to be reasonably inferred by either direct or indirect means. See Michigan Laws 330.3023
- in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. - Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
- Individual overdose review: means the case review of an individual who has died as the result of a drug overdose, including, but not limited to, a review of both of the following:
(i) Consideration of the individual's points of contact, if any, with health care systems, social services, educational institutions, child and family services, the criminal justice system, including law enforcement, and any other system. See Michigan Laws 330.3023Insurer: means an individual, corporation, association, partnership, reciprocal exchange, inter-insurer, Lloyds organization, fraternal benefit society, or other legal entity, engaged or attempting to engage in the business of making insurance or surety contracts. See Michigan Laws 500.106 Intergovernmental agreement: means a contractual agreement between 1 or more governmental agencies, including, but not limited to, an interlocal agreement to jointly exercise any power, privilege, or authority that the agencies share in common and that each might exercise separately under the urban cooperation act of 1967, 1967 (Ex Sess) PA 7, MCL 124. See Michigan Laws 124.753 Local authority: means a local land bank fast track authority created by a qualified city under section 23(5), with the local land bank fast track authority having control over properties within its geographical boundaries, unless that local land bank fast track authority approves an intergovernmental agreement as allowed under this act. See Michigan Laws 124.753 Local unit of government: means a city, village, township, county, or any intergovernmental, metropolitan, or local department, agency, or authority, or other local political subdivision. See Michigan Laws 124.753 Majority leader: see Floor Leaders Mental health provider: means any of the following individuals:
(i) A psychologist as that term is defined in section 18201 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 330.3023Michigan state housing development authority: means the Michigan state housing development authority created under the state housing development authority act of 1966, 1966 PA 346, MCL 125. See Michigan Laws 124.753 Michigan strategic fund: means the Michigan strategic fund as described in the Michigan strategic fund act, 1984 PA 270, MCL 125. See Michigan Laws 124.753 Multidisciplinary team: means a group of professionals from a variety of fields of study or sectors who work together toward a shared purpose. See Michigan Laws 330.3023 Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period. occupational disease: means an illness of the human body arising out of and in the course of an individual's employment and having 1 or more of the following characteristics:
(a) It is caused by a frequently repeated or continuous exposure to a hazardous substance or agent or to a specific industrial practice which is hazardous and which has continued over an extended period of time. See Michigan Laws 333.5601Overdose fatality review team: means the multidisciplinary team established under this act by a county, a group of counties, or a tribe to conduct individual overdose reviews and overdose fatality reviews. See Michigan Laws 330.3023 Participating county: means a county that, by itself or with 1 or more other counties, establishes an overdose fatality review team under section 5(1). See Michigan Laws 330.3023 person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l Personal property: All property that is not real property. Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed. Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide. Qualified city: means 1 of the following:
(i) A city that contains a first class school district. See Michigan Laws 124.753Quorum: The number of legislators that must be present to do business. Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land. Recovery coach: means a professional who provides assistance to support long-term recovery from a substance use disorder. See Michigan Laws 330.3023 shall not apply: means that the pertinent provision is not operative as to certain persons or things or in conjunction with a particular date or dates. See Michigan Laws 8.4c state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o State authority: means the land bank fast track authority created under section 15. See Michigan Laws 124.753 Statute: A law passed by a legislature. Subpoena: A command to a witness to appear and give testimony. Substance use disorder: means a pattern of using alcohol or other drugs that leads to clinical or functional impairment. See Michigan Laws 330.3023 United States: shall be construed to include the district and territories. See Michigan Laws 8.3o
