Terms Used In Michigan Laws > Chapter 38 > Act 429 of 1978 - Salaries and Benefits of Nonclassified State Employees

  • Advance: means a transfer of funds made by a municipality to an authority or to another person on behalf of the authority. See Michigan Laws 125.4301
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Alley: means a public or private right of way shown on a plat which provides secondary access to a lot, block, or parcel of land. See Michigan Laws 560.102
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assessed value: means 1 of the following:
    (i) For valuations made before January 1, 1995, the state equalized valuation as determined under the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 125.4301
  • Authority: means a tax increment finance authority created under this part. See Michigan Laws 125.4301
  • Authority district: means that area within which an authority exercises its powers and within which 1 or more development areas may exist. See Michigan Laws 125.4301
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Board: means the ski area safety board. See Michigan Laws 408.322
  • Board: means the governing body of an authority. See Michigan Laws 125.4301
  • Caption: means the name by which the plat is legally and commonly known. See Michigan Laws 560.102
  • Captured assessed value: means the amount in any 1 year by which the current assessed value of the development area, including the assessed value of property for which specific local taxes are paid in lieu of property taxes as determined in subdivision (w), exceeds the initial assessed value. See Michigan Laws 125.4301
  • Commission: means the Michigan community service commission established in section 2. See Michigan Laws 408.221
  • Commissioner: means the director of commerce or an authorized representative of the director. See Michigan Laws 408.322
  • Community-based agency: means that term as defined in section 101 of title I, 42 U. See Michigan Laws 408.221
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: means the corporation for national and community service established in section 191 of title I, 42 U. See Michigan Laws 408.221
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Council: means the advisory council on deaf, deafblind, and hard of hearing established in section 5. See Michigan Laws 408.202
  • council: means that advisory body established pursuant to section 20. See Michigan Laws 125.4301
  • County plat board: means the register of deeds, who shall act as chairperson, the county clerk, who shall act as secretary, and the county treasurer. See Michigan Laws 560.102
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the department of civil rights. See Michigan Laws 408.202
  • Department: means the state department of commerce. See Michigan Laws 408.322
  • Dependent: A person dependent for support upon another.
  • Development area: means that area to which a development plan is applicable. See Michigan Laws 125.4301
  • Development plan: means that information and those requirements for a development set forth in section 16. See Michigan Laws 125.4301
  • Development program: means the implementation of the development plan. See Michigan Laws 125.4301
  • district: means that area to which the tax increment finance plan pertains. See Michigan Laws 125.4301
  • Division: means the division on deaf, deafblind, and hard of hearing established in section 3. See Michigan Laws 408.202
  • Eligible advance: means an advance made before August 19, 1993. See Michigan Laws 125.4301
  • Eligible obligation: means an obligation issued or incurred by an authority or by a municipality on behalf of an authority before August 19, 1993 and its subsequent refunding by a qualified refunding obligation. See Michigan Laws 125.4301
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Exempt split: means the partitioning or splitting of a parcel or tract of land by the proprietor thereof or by his or her heirs, executors, administrators, legal representatives, successors, or assigns that does not result in 1 or more parcels of less than 40 acres or the equivalent. See Michigan Laws 560.102
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fiscal year: means the fiscal year of the authority. See Michigan Laws 125.4301
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Governing body: means the elected body of a municipality having legislative powers. See Michigan Laws 125.4301
  • Governing body: means the legislative body of a city or village or the township board of a township. See Michigan Laws 560.102
  • grantee: may be construed as including every person to whom any such interest or estate passes in like manner. See Michigan Laws 8.3e
  • Hard of hearing person: means a person who has hearing loss that ranges from mild to profound. See Michigan Laws 408.202
  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 8.3q
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Land: means all land areas occupied by real property. See Michigan Laws 560.102
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Lot: means a measured portion of a parcel or tract of land, which is described and fixed in a recorded plat. See Michigan Laws 560.102
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Municipality: means a township, city, or village. See Michigan Laws 560.102
  • Municipality: means a city. See Michigan Laws 125.4301
  • National service laws: means that term as defined in section 101 of title I, 42 U. See Michigan Laws 408.221
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Obligation: means a written promise to pay, whether evidenced by a contract, agreement, lease, sublease, bond, or note, or a requirement to pay imposed by law. See Michigan Laws 125.4301
  • Operator: means a person who owns or controls, or who has operational responsibility for, a ski area or ski lift. See Michigan Laws 408.322
  • Other protected obligation: means :
  •     (i) A qualified refunding obligation issued to refund an obligation described in subparagraph (ii) or (iii), an obligation that is not a qualified refunding obligation that is issued to refund an eligible obligation, or a qualified refunding obligation issued to refund an obligation described in this subparagraph. See Michigan Laws 125.4301
  • Out-of-school youth: means that term as defined in section 101 of title I, 42 U. See Michigan Laws 408.221
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Parcel: means a continuous area or acreage of land which can be described as provided for in this act. See Michigan Laws 560.102
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Passenger: means a person, skier or nonskier, who boards, disembarks from, or is transported by a ski lift, regardless of whether the ski lift is being used during the skiing season or nonskiing season, and includes a person waiting for or moving away from the loading or unloading point of a ski lift. See Michigan Laws 408.322
  • person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l
  • Personal property: All property that is not real property.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plat: means a map or chart of a subdivision of land. See Michigan Laws 560.102
  • Proprietor: means a natural person, firm, association, partnership, corporation, or combination of any of them that holds an ownership interest in land whether recorded or not. See Michigan Laws 560.102
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public sewer: means a sewerage system as defined in section 4101 of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 560.102
  • Public utility: means all persons, firms, corporations, copartnerships, or municipal or other public authority providing gas, electricity, water, steam, telephone, sewer, or other services of a similar nature. See Michigan Laws 560.102
  • Public water: means a system of pipes and structures through which water is obtained and distributed to the public, including wells and well structures, intakes, and cribs, pumping stations, treatment plants, reservoirs, storage tanks and appurtenances, collectively or severally, actually used or intended for use for the purpose of furnishing water to the public for household or drinking purposes. See Michigan Laws 560.102
  • Quorum: The number of legislators that must be present to do business.
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • seal: shall be construed to include any of the following:
  •     (a) The impression of the seal on the paper alone. See Michigan Laws 8.3n
  • Service of process: The service of writs or summonses to the appropriate party.
  • Ski area: means an area used for skiing and served by 1 or more ski lifts. See Michigan Laws 408.322
  • Ski lift: means a device for transporting persons uphill on skis, or in cars on tracks, or suspended in the air by the use of cables, chains, belts, or ropes, and usually supported by trestles or towers with 1 or more spans. See Michigan Laws 408.322
  • Skier: means a person wearing skis or utilizing a device that attaches to at least 1 foot or the lower torso for the purpose of sliding on a slope. See Michigan Laws 408.322
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  • Statute: A law passed by a legislature.
  • subdivision: means the partitioning or splitting of a parcel or tract of land by the proprietor thereof or by his or her heirs, executors, administrators, legal representatives, successors, or assigns for the purpose of sale, or lease of more than 1 year, or of building development that results in 1 or more parcels of less than 40 acres or the equivalent, and that is not exempted from the platting requirements of this act by section 108 and 109. See Michigan Laws 560.102
  • Surveyor: means a professional surveyor licensed under article 20 of the occupational code, 1980 PA 299, MCL 339. See Michigan Laws 560.102
  • Tax increment financing plan: means that information and those requirements set forth in section 313 to 315. See Michigan Laws 125.4301
  • Tax increment revenues: means the amount of ad valorem property taxes and specific local taxes attributable to the application of the levy of all taxing jurisdictions upon the captured assessed value of real and personal property in the development area, subject to the following requirements:
  •     (i) Tax increment revenues include ad valorem property taxes and specific local taxes attributable to the application of the levy of all taxing jurisdictions other than the state pursuant to the state education tax act, 1993 PA 331, MCL 211. See Michigan Laws 125.4301
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • United States: shall be construed to include the district and territories. See Michigan Laws 8.3o
