- Accommodations: means the room or other space provided to transient guests for dwelling, lodging, or sleeping, including furnishings and other accessories, in a facility that is not a campground, hospital, nursing home, emergency shelter, or community mental health or community substance abuse treatment facility. See Michigan Laws 207.623
- Accommodations: means the room or other space provided for sleeping, including furnishings and other accessories in the room but not including the provision of food, beverages, telephone services, television or movie services, or other similar services, in a facility that is not a hospital, nursing home, emergency shelter, community mental health or community substance abuse treatment facility, or campground. See Michigan Laws 207.751
- Adjusted household income: means that term as defined in R 125. See Michigan Laws 207.902
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Advisory board: means each of the following:
(i) The building officials advisory board described in section 1005. See Michigan Laws 339.6001Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths. Affiliated business: means a business that is at least 50% owned and controlled, directly or indirectly, by an associated business. See Michigan Laws 207.803 Air conditioning: means the process of treating air to meet the requirements of a conditioned space by controlling, either simultaneously or individually, the air's temperature, humidity, cleanness, and distribution. See Michigan Laws 339.5801 Alcohol: means fuel grade ethanol or a mixture of fuel grade ethanol and another product. See Michigan Laws 207.1002 Allegation: something that someone says happened. Alternative energy marine propulsion system: means an onboard propulsion system or detachable outboard propulsion system for a watercraft that is powered by an alternative energy system and that is the singular propulsion system for the watercraft. See Michigan Laws 207.822 Alternative energy system: means the small-scale generation or release of energy from 1 or any combination of the following types of energy systems:
(i) A fuel cell energy system. See Michigan Laws 207.822Alternative energy technology: means equipment, component parts, materials, electronic devices, testing equipment, and related systems that are specifically designed, specifically fabricated, and used primarily for 1 or more of the following:
(i) The storage, generation, reformation, or distribution of clean fuels integrated within an alternative energy system or alternative energy vehicle, not including an anaerobic digester energy system or a hydroelectric energy system, for use within the alternative energy system or alternative energy vehicle. See Michigan Laws 207.822Alternative energy technology business: means a business engaged solely in the research, development, or manufacturing of alternative energy technology. See Michigan Laws 207.822 Alternative energy vehicle: means a motor vehicle manufactured by an original equipment manufacturer that fully warrants and certifies that the motor vehicle meets federal motor vehicle safety standards for its class of vehicles as defined by the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 207.822 Alternative energy zone: means a renaissance zone designated as an alternative energy zone by the board of the Michigan strategic fund under section 8a of the Michigan renaissance zone act, 1996 PA 376, MCL 125. See Michigan Laws 207.822 alternative fueled vehicle: means a motor vehicle that can only be powered by a clean fuel energy system and can only be fueled by a clean fuel. See Michigan Laws 207.822 Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it. Anaerobic digester energy system: means a device or system of devices for optimizing the anaerobic digestion of biomass for the purpose of recovering biofuel for energy production. See Michigan Laws 207.822 Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year. Antique steam boiler: means a boiler that is no longer used in production applications and is used to demonstrate the historical significance of steam boilers in American history. See Michigan Laws 339.5901 Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant. Apprentice electrician: means an individual other than an electrical contractor, master electrician, or electrical journeyman, who is engaged in learning about and assisting in the installation or alteration of electrical wiring and equipment under the direct personal supervision of an electrical journeyman or master electrician. See Michigan Laws 339.5701 Apprentice plumber: means an individual who is registered under this article as an apprentice. See Michigan Laws 339.6101 Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization Approved: means reviewed and found acceptable by the commission. See Michigan Laws 339.6001 Approved apprenticeship program: means a training program for boiler operators or stationary engineers that is certified by or meets the standards of the Office of Apprenticeship in the United States Department of Labor and is approved by the board. See Michigan Laws 339.5901 Armed forces: means the United States Army, Air Force, Navy, Marine Corps, Space Force, or Coast Guard or other military force designated by Congress as a part of the Armed Forces of the United States, including the reserve components. See Michigan Laws 339.5103 Arrest: Taking physical custody of a person by lawful authority. Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account. Associated auxiliaries: means equipment that is required in the operation of a boiler that includes, but is not limited to, pumps, regulators, feedwater heaters, superheaters, de-superheaters, economizers, air preheaters, draft fans, combustion and pollution control equipment, and prime movers. See Michigan Laws 339.5901 Associated business: means a business that owns at least 50% of and controls, directly or indirectly, an authorized business. See Michigan Laws 207.803 Attachment: A procedure by which a person's property is seized to pay judgments levied by the court. Attainable housing property: means that portion of real property not occupied by an owner of that real property of not more than 4 units that is classified as residential real property under section 34c of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.902 Authority: means the Michigan economic growth authority created under section 4. See Michigan Laws 207.803 Authority: means the Michigan next energy authority created under section 3. See Michigan Laws 207.822 Authorized business: means 1 of the following:
(i) A single eligible business with a unique federal employer identification number that has met the requirements of section 8 and with which the authority has entered into a written agreement for a tax credit under section 9. See Michigan Laws 207.803Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings. Battery cell: means a closed electrochemical system that converts chemical energy from oxidation and reduction reactions directly into electric energy without combustion and without external fuel and consists of an anode, a cathode, and an electrolyte. See Michigan Laws 207.822 Battery cell energy system: means 1 or more battery cells and an inverter or other power conditioning unit used to perform 1 or more of the following functions:
(i) Propel a motor vehicle or an alternative energy marine propulsion system. See Michigan Laws 207.822Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC biodiesel: means a diesel fuel substitute consisting of methyl or ethyl esters produced from the transesterification of animal or vegetable fats with methanol or ethanol. See Michigan Laws 207.822 biomass: means wood and paper products industries, food production and processing, trees and grasses grown specifically to be used as energy crops, and gaseous fuels produced from solid biomass, animal waste, municipal wastes, or landfills. See Michigan Laws 207.822 Biomass energy system: means a system that generates energy from a process using residues from wood and paper products industries, food production and processing, trees and grasses grown specifically to be used as energy crops, and gaseous fuels produced from solid biomass, animal waste, municipal wastes, or landfills. See Michigan Laws 207.822 Blended motor fuel: means a mixture of motor fuel and another liquid, other than a de minimis amount of a product including, but not limited to, carburetor detergent or oxidation inhibitor, that can be used as motor fuel in a motor vehicle. See Michigan Laws 207.1002 blending: means the mixing of 1 or more petroleum products, with or without another product, regardless of the original character of the product blended, if the product obtained by the blending is capable of use in the generation of power for the propulsion of a motor vehicle, an airplane, or a marine vessel. See Michigan Laws 207.1002 Blendstock: means and includes any petroleum product component of motor fuel, such as naphtha, reformate, or toluene; or any oxygenate that can be blended for use in a motor fuel. See Michigan Laws 207.1002 Board: means the governing body of an authority under section 4. See Michigan Laws 207.822 Board: means the electrical administrative board described in section 705. See Michigan Laws 339.5701 Board: means the board of mechanical rules described in section 805. See Michigan Laws 339.5801 Board: means the board of boiler rules described in section 905. See Michigan Laws 339.5901 Board: means the state plumbing board described in section 1105. See Michigan Laws 339.6101 Board: means , in each article of this act that is related to a specific occupation or occupations, the board that is created in that article and composed principally of members of the regulated occupation or occupations, or the commission or other agency that is defined in or designated as the board for purposes of that article. See Michigan Laws 339.5103 Board files: means the records, memoranda, opinions, minutes, and similar written materials that were formerly in the physical possession and control of a board abolished by this act and the records, memoranda, opinions, minutes, and similar written materials of a board created under this act. See Michigan Laws 339.5103 Boiler: means a closed vessel in which water is heated, steam is generated, or steam is superheated, or a combination of those actions occurs, under pressure or vacuum by the application of heat from combustible fuels, electricity, or nuclear energy. See Michigan Laws 339.5901 Building official: means a construction code enforcement person working as an inspector, or plan reviewer, or actively engaged in the administration and enforcement of adopted building, electrical, mechanical, or plumbing codes, or any combination of these codes. See Michigan Laws 339.6001 Building sewer: means that part of the drainage system that extends from the end of the building drain and conveys its discharge to a public sewer, private sewer, individual sewage disposal system, or other point of disposal. See Michigan Laws 339.6101 Bulk plant: means a motor fuel storage and distribution facility that is not a terminal and from which motor fuel may be withdrawn by a tank wagon, a transport truck, or a marine vessel. See Michigan Laws 207.1002 Bulk transfer: means a transfer of motor fuel from 1 location to another by pipeline tender or marine delivery within the bulk transfer/terminal system, including, but not limited to, all of the following transfers:
(i) A marine vessel movement of motor fuel from a refinery or terminal to a terminal. See Michigan Laws 207.1002Business: means proprietorship, joint venture, partnership, limited liability partnership, trust, business trust, syndicate, association, joint stock company, corporation, cooperative, limited liability company, or any other organization. See Michigan Laws 207.803 Carrier: means an operator of a pipeline or marine vessel engaged in the business of transporting motor fuel above the terminal rack. See Michigan Laws 207.1002 casino: means a casino or a parking lot, hotel, motel, or retail store owned or operated by a casino, an affiliate, or an affiliated company, regulated by this state pursuant to the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 207.662 casino: means a casino or a parking lot, hotel, motel, or retail store owned or operated by a casino, an affiliate, or an affiliated company, regulated by this state pursuant to the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 207.842 Censure: means an expression of disapproval of a licensee's or registrant's professional conduct, whether or not the conduct is a violation of this act or a rule promulgated or an order issued under this act. See Michigan Laws 339.5103 certificate: means a certificate issued pursuant to sections 4, 5, and 6. See Michigan Laws 207.772 certificate: means the certificate issued under section 6. See Michigan Laws 207.842 certificate: means the certificate issued under section 6. See Michigan Laws 207.902 certificate: means the certificate issued under section 6. See Michigan Laws 207.952 Certificate inspection: means an inspection that is conducted for purposes of preparing a report described in section 945. See Michigan Laws 339.5901 Charitable organization: means a not-for-profit tax-exempt religious, educational, or humane organization. See Michigan Laws 339.5103 Chief executive officer: means for a county the county executive of a county or, if the county does not have an elected county executive, the chairperson of the county board of commissioners and for a city, the mayor. See Michigan Laws 207.751 Child care center: means that term as defined in section 1 of 1973 PA 116, MCL 722. See Michigan Laws 380.1903 CHP energy system: means an integrated unit that generates power and either cools, heats, or controls humidity in a building or provides heating, drying, or chilling for an industrial process that includes and is limited to both of the following:
(i) An absorption chiller, a desiccant dehumidifier, or heat recovery equipment. See Michigan Laws 207.822Citation: means that term as described in section 537. See Michigan Laws 339.5103 Clean fuel: means 1 or more of the following:
(i) Methane. See Michigan Laws 207.822Clean fuel energy system: means a device that is designed and used solely for the purpose of generating power from a clean fuel. See Michigan Laws 207.822 Commercial housing facilities exemption certificate: means a certificate issued pursuant to sections 3, 4, and 5. See Michigan Laws 207.601 Commercial motor vehicle: means a motor vehicle licensed as a qualified commercial motor vehicle under the motor carrier fuel tax act, 1980 PA 119, MCL 207. See Michigan Laws 207.1002 Commercial property: means land improvements classified by law for general ad valorem tax purposes as real property including real property assessable as personal property pursuant to sections 8(d) and 14(6) of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.842 Commercial rehabilitation tax: means the specific tax levied under this act. See Michigan Laws 207.842 Commission: means the state tax commission created by Act No. See Michigan Laws 207.601 Commission: means the state tax commission created by 1927 PA 360, MCL 209. See Michigan Laws 207.772 Commission: means the state tax commission created by 1927 PA 360, MCL 209. See Michigan Laws 207.842 Commission: means the state tax commission created by 1927 PA 360, MCL 209. See Michigan Laws 207.952 Commission: means the state construction code commission created in section 3a of the Stille-DeRossett-Hale single state construction code act, 1972 PA 230, MCL 125. See Michigan Laws 339.6001 Commissioner: means the director. See Michigan Laws 500.102 Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action. Community college: means a community college established under the community college act of 1966, 1966 PA 331, MCL 389. See Michigan Laws 388.513 Competence: means a degree of expertise that enables an individual to engage in an occupation at a level that meets or exceeds minimal standards of acceptable practice for the occupation. See Michigan Laws 339.5103 Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant. Complaint: means an oral or written grievance. See Michigan Laws 339.5103 Completed application: means an application that is complete on its face and submitted with any applicable licensing or permit fees and any other information, records, approval, security, or similar item required by law or rule from a local unit of government, a federal agency, or a private entity but not from another department or agency of this state. See Michigan Laws 339.5103 Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law. Condominium unit: means that portion of a structure intended for separate ownership, intended for residential use, and established under the condominium act, 1978 PA 59, MCL 559. See Michigan Laws 207.772 Consumer price index: means United States consumer price index for all urban consumers as defined and reported by the United States Department of Labor, Bureau of Labor Statistics. See Michigan Laws 207.1002 Contested case hearing: means a hearing under chapter 4 of the administrative procedures act of 1969, MCL 24. See Michigan Laws 339.5103 Continuance: Putting off of a hearing ot trial until a later time. Contract: A legal written agreement that becomes binding when signed. Convention facility: means 1 or more facilities owned or leased by a local governmental unit or metropolitan authority created under the regional convention facility authority act, 2008 PA 554, MCL 141. See Michigan Laws 207.623 Convention facility: means a convention exhibition facility, including meeting rooms and necessary sites, related parking lots or structures, and appurtenant properties and facilities, if the facility itself contains not less than 50,000 square feet of exhibition space and if the eligible municipality is a county, the facility is located within the boundaries of the most populous city in the county. See Michigan Laws 207.751 Convention hotel: means a facility used in the business of providing accommodations that has more than 80 rooms for providing accommodations to transient guests and that complies with all of the following:
(i) Is located within a county having a population according to the most recent decennial census of 700,000 or more. See Michigan Laws 207.623Conviction: A judgement of guilt against a criminal defendant. Cooling: means air conditioning as defined in subdivision (a). See Michigan Laws 339.5801 Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name. Critical health problems education program: means a systematic and integrated program designed to provide appropriate learning experiences based on scientific knowledge of the human organism as it functions within its environment and designed to favorably influence the health, understanding, attitudes and practices of the individual child which will enable him to adapt to changing health problems of our society. See Michigan Laws 388.382 Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries. Department: means the department of management and budget. See Michigan Laws 207.822 Department: means the department of treasury. See Michigan Laws 207.842 Department: means the department of treasury. See Michigan Laws 207.902 Department: means the department of treasury. See Michigan Laws 207.952 Department: means the department of treasury or its designee. See Michigan Laws 207.1002 Department: means the department of environment, Great Lakes, and energy or its authorized agent or representative. See Michigan Laws 380.1903 Department: means the department of education. See Michigan Laws 388.513 Department: means the department of licensing and regulatory affairs. See Michigan Laws 339.5103 Department: means the department of insurance and financial services. See Michigan Laws 500.102 Dependent: A person dependent for support upon another. Dependent: means a spouse, surviving spouse, child under 26 years of age, or surviving child under 26 years of age. See Michigan Laws 339.5103 Destination state: means a state, Canadian province or territory, or foreign country to which motor fuel is directed for export. See Michigan Laws 207.1002 Developer: means a person who is the owner of a new facility at the time of construction or of a rehabilitated facility at the time of rehabilitation for which a neighborhood enterprise zone certificate is applied for or issued. See Michigan Laws 207.772 Diesel fuel: means any liquid other than gasoline that is capable of use as a fuel or a component of a fuel in a motor vehicle that is propelled by a diesel-powered engine or in a diesel-powered train. See Michigan Laws 207.1002 Director: means the director of the department of licensing and regulatory affairs or his or her authorized representative. See Michigan Laws 339.5103 Director: means , unless the context clearly implies a different meaning, the director of the department. See Michigan Laws 500.102 Dismissal: The dropping of a case by the judge without further consideration or hearing. Source: Distressed business: means a business that meets all of the following as verified by the Michigan economic growth authority:
(i) Four years immediately preceding the application to the authority under this act, the business had 150 or more full-time jobs in this state. See Michigan Laws 207.803district: means an area not less than 3 acres in size of a qualified local governmental unit established as provided in section 3. See Michigan Laws 207.842 district: means an area in a qualified local governmental unit established as provided in section 3 in which attainable housing property is or will be located. See Michigan Laws 207.902 district: means an area not less than 1 acre in size of a qualified local governmental unit established as provided in section 3. See Michigan Laws 207.952 Domestic water treatment and filtering equipment: means residential water treatment and filtering equipment used in 1-family and 2-family dwellings. See Michigan Laws 339.6101 Drinking fountain: means a plumbing fixture that is connected to the potable water distribution system and drainage system that allows a user to obtain a drink directly from a stream of flowing water without the use of any accessory. See Michigan Laws 380.1903 Ductwork: means the air distribution arrangement for supply, return, and exhaust in air conditioning systems and in nonair conditioning systems, the materials and methods of which are specified in the Michigan mechanical code, or an equivalent nationally recognized model mechanical code. See Michigan Laws 339.5801 Dyed diesel fuel: means diesel fuel that is dyed in accordance with internal revenue service rules or pursuant to any other internal revenue service requirements, including any invisible marker requirements. See Michigan Laws 207.1002 Electric sign: means fixed, stationary, or portable self-contained, electrically illuminated equipment that has words or symbols designed to convey information or attract attention. See Michigan Laws 339.5701 electric vehicle: means a motor vehicle powered solely by a battery cell energy system. See Michigan Laws 207.822 Electrical contractor: means a person that is engaged in the business of erecting, installing, altering, repairing, servicing, or maintaining electrical wiring. See Michigan Laws 339.5701 Electrical journeyman: means an individual other than an electrical contractor who, as his or her principal occupation, is engaged in the practical installation or alteration of electrical wiring. See Michigan Laws 339.5701 Electrical wiring: means all wiring, generating equipment, fixtures, appliances, devices, and appurtenances in connection with the generation, distribution, and utilization of electrical energy, in or on a building, residence, structure, or properties, regardless of whether or not the electrical wiring is energized at the time of installation. See Michigan Laws 339.5701 Electricity storage device: means a device, including a capacitor, that directly stores electrical energy without conversion to an intermediary medium. See Michigan Laws 207.822 Electricity storage system: means 1 or more electricity storage devices and inverters or other power conditioning equipment. See Michigan Laws 207.822 Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC Eligible business: means a distressed business or business that proposes to maintain retained jobs after December 31, 1999 or to create qualified new jobs in this state after April 18, 1995 in manufacturing, mining, research and development, wholesale and trade, film and digital media production, or office operations or a business that is a qualified high-technology business or a business that is a tourism attraction facility or a qualified lodging facility. See Michigan Laws 207.803 Eligible charges: means tuition and mandatory course fees, material fees, and registration fees required by an eligible institution for enrollment in an eligible course. See Michigan Laws 388.513 Eligible county: means a county with a population of 1,500,000 or more persons that adopts or has adopted a charter under 1966 PA 293, MCL 45. See Michigan Laws 207.751 Eligible course: means a course offered by an eligible postsecondary institution that is offered for postsecondary credit; that is not offered by the school district or state approved nonpublic school in which the eligible student is enrolled, or that is offered by the school district or state approved nonpublic school but is determined by its governing board to not be available to the eligible student because of a scheduling conflict beyond the eligible student's control; that is an academic course not ordinarily taken as an activity course; that is a course that the postsecondary institution normally applies toward satisfaction of degree requirements; that is offered in whole or in part when the school district or state approved nonpublic school is in session or, if approved by the school district or state approved nonpublic school, that is offered in whole when the school district or state approved nonpublic school is not in session; that is not a hobby, craft, or recreational course; and that is in a subject area other than physical education, theology, divinity, or religious education. See Michigan Laws 388.513 Eligible municipality: means any of the following:
(i) An eligible county that intends to impose a tax under this act for purposes related to a stadium as defined under subdivision (i)(i). See Michigan Laws 207.751Eligible postsecondary institution: means a state university, community college, or independent nonprofit degree-granting college or university that is located in this state and that chooses to comply with this act. See Michigan Laws 388.513 Eligible student: means , except as otherwise provided in this subdivision, a student enrolled in at least 1 high school class in a school district or state approved nonpublic school in this state, except a foreign exchange pupil enrolled under a cultural exchange program or a student who does not have at least 1 parent or legal guardian who is a resident of this state. See Michigan Laws 388.513 Enforcing agency: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105 Enrollee: means an individual who is entitled to receive health services under a health insurance contract, unless the context requires otherwise. See Michigan Laws 500.116 Escrow: Money given to a third party to be held for payment until certain conditions are met. Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other. Ex officio: Literally, by virtue of one's office. Excluded liquid: means that term as defined in 26 C. See Michigan Laws 207.1002 experience: includes any relevant experience acquired while serving in the armed forces by an individual who was separated from that service if all of the following are met:
(a) The applicant provides to the department a form DD214, a form DD215, or any other form that is satisfactory to the department that demonstrates that he or she was separated from that service, with an honorable character of service or under honorable conditions (general) character of service. See Michigan Laws 339.5903Export: means to obtain motor fuel in this state for sale or other distribution outside of this state. See Michigan Laws 207.1002 Exporter: means a person who exports motor fuel. See Michigan Laws 207.1002 External inspection: means an inspection that does not involve examination of the internal surfaces of the pressure parts of the boiler. See Michigan Laws 339.5901 Facility: means a homestead facility, a new facility, or a rehabilitated facility. See Michigan Laws 207.772 Facility: means a site or sites within this state in which an authorized business or subsidiary business maintains retained jobs or creates qualified new jobs. See Michigan Laws 207.803 Film and digital media production: means the development, preproduction, production, postproduction, and distribution of single media or multimedia entertainment content for distribution or exhibition to the general public in 2 or more states by any means and media in any digital media format, film, or video tape, including, but not limited to, a motion picture, a documentary, a television series, a television miniseries, a television special, interstitial television programming, long-form television, interactive television, music videos, interactive games, video games, internet programming, an internet video, a sound recording, a video, digital animation, or an interactive website. See Michigan Laws 207.803 Filtered faucet: means a faucet that at the point of use includes a filter that is certified to meet NSF/ANSI standard 53 for lead reduction and NSF/ANSI standard 42 for particulate removal. See Michigan Laws 380.1903 Fire alarm contractor: means a person that is engaged in the business of erecting, installing, altering, repairing, servicing, or maintaining wiring, devices, appliances, or equipment of a fire alarm system. See Michigan Laws 339.5701 Fire alarm specialty apprentice technician: means an individual other than a fire alarm contractor or a fire alarm specialty technician who is engaged in learning about and assisting in the installation or alteration of fire alarm system wiring and equipment under the direct personal supervision of a fire alarm specialty technician. See Michigan Laws 339.5701 Fire alarm specialty licensure: means licensure as a fire alarm contractor or a fire alarm specialty or apprentice technician. See Michigan Laws 339.5701 Fire alarm specialty technician: means an individual other than a fire alarm contractor who, as his or her principal occupation, is engaged in the design and practical installation or alteration of fire alarm systems. See Michigan Laws 339.5701 Fire alarm system: means a system that is designed to detect and annunciate the presence of fire, or by-products of fire, installed in a building or structure. See Michigan Laws 339.5701 Fire protection system: means that term as defined in the Michigan building code. See Michigan Laws 339.6001 Fire protection system inspector: means an individual who meets the qualifications established under this article and is responsible for the inspection of fire protection systems in accordance with the design and installation standards referenced by the Michigan building code. See Michigan Laws 339.6001 Fire protection system plan reviewer: means an individual who meets the qualifications established under this article and is responsible for the review of fire protection system plans in accordance with the design and installation standards referenced by the Michigan building code. See Michigan Laws 339.6001 Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006. Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC Formal complaint: means a document that states the charges of each alleged violation and is prepared by the department or the department of attorney general after a complaint is received by the department. See Michigan Laws 339.5105 Former act: means former 1956 PA 217; former 1984 PA 192; former 1986 PA 54; former 2002 PA 733; or former 1965 PA 290, as applicable. See Michigan Laws 339.5105 Fraud: Intentional deception resulting in injury to another. Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC Fuel cell: means an electrochemical device that uses an external fuel and continuously converts the energy released from the oxidation of fuel by oxygen directly into electricity without combustion and consists of an anode, a cathode, and an electrolyte. See Michigan Laws 207.822 Fuel cell energy system: means 1 or more fuel cells or fuel cell stacks and an inverter or other power conditioning unit. See Michigan Laws 207.822 fuel cell vehicle: means a motor vehicle powered solely by a fuel cell energy system. See Michigan Laws 207.822 Fuel feedstock user: means a person who receives motor fuel for the person's own use in the manufacture or production of any substance other than motor fuel. See Michigan Laws 207.1003 Fuel grade ethanol: means the American Society for Testing and Materials standard in effect on April 1, 2001 as the D-4806 specification for denatured fuel grade ethanol for blending with gasoline. See Michigan Laws 207.1003 Fuel processor: means a device that converts a fuel, including, but not limited to, methanol, natural gas, or gasoline, into a hydrogen rich gas, without combustion for use in a fuel cell. See Michigan Laws 207.822 Fuel transportation vehicle: means a vehicle designed or used to transport motor fuel on the public roads or highways. See Michigan Laws 207.1003 Full-time job: means a job performed by an individual for 35 hours or more each week and whose income and Social Security taxes are withheld by 1 or more of the following:
(i) An authorized business. See Michigan Laws 207.803Fund: means the school and child care center clean drinking water fund created in section 11. See Michigan Laws 380.1903 Gallon: means a unit of liquid measure as customarily used in the United States containing 231 cubic inches, or 4 quarts, or its metric equivalent expressed in liters. See Michigan Laws 207.1003 Gasohol: means a blended motor fuel composed of gasoline and fuel grade ethanol. See Michigan Laws 207.1003 Gasoline: means gasoline, alcohol, gasohol, casing head or natural gasoline, benzol, benzine, naphtha, and any blendstock additive, or other product including methanol that is sold for blending with gasoline or for use on the road other than products typically sold in containers of less than 5 gallons. See Michigan Laws 207.1003 General public: means each individual who resides in this state and is 18 years of age or older, other than an individual or the spouse of an individual who is licensed or registered in the occupation or who has a material financial interest in the occupation that is regulated by the specific article in which the term is used. See Michigan Laws 339.5105 Good moral character: means that term as defined in, and determined under, 1974 PA 381, MCL 338. See Michigan Laws 339.5105 Governmental subdivision: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105 Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve Gross gallons: means the total measured product, exclusive of any temperature or pressure adjustments, considerations, or deductions, in gallons. See Michigan Laws 207.1003 Gross receipts: means that term as defined in former section 7 of 1975 PA 228, or section 111 of the Michigan business tax act, 2007 PA 36, MCL 208. See Michigan Laws 207.751 group disability insurance: means voluntary disability insurance that covers 2 or more employees or members, with or without their eligible dependents, written under a master policy issued to a governmental corporation, unit, agency, or department of a governmental entity, to a corporation, copartnership, or individual employer, or, on application of an executive officer or trustee of the association, to an association that has a constitution or bylaws and that is formed in good faith for purposes other than that of obtaining insurance, and under which officers, members, employees, or classes or departments of the association may be insured for their individual benefit. See Michigan Laws 500.607 Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs. Health insurance policy: means an expense-incurred hospital, medical, or surgical policy, certificate, or contract. See Michigan Laws 500.608 Health maintenance organization: means that term as defined in section 3501. See Michigan Laws 500.106 Heating surface: means the heating surface determined by the boiler manufacturer and recorded in the manufacturer's data report or by rules established by the board for a boiler if the manufacturer's data report is not available or the boiler is not stamped with its heating surface. See Michigan Laws 339.5901 High-technology activity: means 1 or more of the following:
(i) Advanced computing, which is any technology used in the design and development of any of the following:
(A) Computer hardware and software. See Michigan Laws 207.803Homestead facility: means 1 of the following:
(i) An existing structure, purchased by or transferred to an owner after December 31, 1996, that has as its primary purpose residential housing consisting of 1 or 2 units, 1 of which is occupied by an owner as his or her principal residence and that is located within a subdivision platted pursuant to state law before January 1, 1968 other than an existing structure for which a certificate will or has been issued after December 31, 2006 in a city with a population of 750,000 or more, is located within a subdivision platted pursuant to state law before January 1, 1968. See Michigan Laws 207.772HVAC: means the application of equipment and systems to provide air conditioning for occupants of buildings and structures. See Michigan Laws 339.5801 hybrid electric vehicle: means a motor vehicle powered by an integrated propulsion system consisting of an electric motor and combustion engine. See Michigan Laws 207.822 hybrid vehicle: means a motor vehicle that can only be powered by an internal combustion engine and 1 or more alternative energy systems. See Michigan Laws 207.822 hydraulic hybrid vehicle: means a motor vehicle powered by a regenerative hydraulic drive system or powered by an internal combustion engine assisted by a regenerative hydraulic drive system. See Michigan Laws 207.822 Hydroelectric energy system: means a system related to the process of generating or putting into usable form the energy produced solely from flowing or falling water. See Michigan Laws 207.822 Implement of husbandry: means a farm tractor, a vehicle designed to be drawn or pulled by a farm tractor or animal, a vehicle that directly harvests farm products, or a vehicle that directly applies fertilizer, spray, or seeds to a farm field. See Michigan Laws 207.1003 Import: means to bring motor fuel into this state by motor vehicle, marine vessel, pipeline, or any other means. See Michigan Laws 207.1003 Importer: means a person who imports motor fuel into this state. See Michigan Laws 207.1003 In this state: means the area within the borders of this state, including all territories within the borders owned by, held in trust by, or added to the United States of America. See Michigan Laws 207.1003 in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 8.3q Income-qualified household: means an individual, couple, family, or group of unrelated individuals whose adjusted household income is 120% or less of the countywide area median income as posted annually by the Michigan state housing development authority on its website. See Michigan Laws 207.902 Incompetence: means a departure from, or a failure to conform to, minimal standards of acceptable practice for an occupation. See Michigan Laws 339.5105 Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC Inflation rate: means the annual percentage change in the consumer price index, as determined by the department, comparing the 2 most recent October 1 through September 30 periods that are immediately preceding the effective date of the rate prescribed under section 8(1)(c), converted to decimals. See Michigan Laws 207.1003 Inspector: means the individual who is responsible for the administration and enforcement of the construction of buildings, structures, or appurtenances under the state construction code. See Michigan Laws 339.6003 insurance contract: means a contract of insurance, indemnity, suretyship, or annuity issued or proposed or intended for issuance by a person engaged in the business of insurance. See Michigan Laws 500.116 Insurance producer: means that term as defined in section 1201. See Michigan Laws 500.116 Insurer: means an individual, corporation, association, partnership, reciprocal exchange, inter-insurer, Lloyds organization, fraternal benefit society, or other legal entity, engaged or attempting to engage in the business of making insurance or surety contracts. See Michigan Laws 500.106 Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC Intermediate school district: means that term as defined in section 4 of the revised school code, MCL 380. See Michigan Laws 380.1895 Jobsite: means the immediate work area within the property lines of a single construction project, alteration project, or maintenance project where electrical construction or alteration of electrical wiring is in progress. See Michigan Laws 339.5703 Journey plumber: means an individual, other than a plumbing contractor or master plumber, who is qualified to engage in the practical installation of plumbing and who is licensed as a journey plumber. See Michigan Laws 339.6101 Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases. Kerosene: means all grades of kerosene, including, but not limited to, the 2 grades of kerosene, No. See Michigan Laws 207.1004 Leaded racing fuel: is a fuel other than diesel fuel that is leaded and at least 100 octane and is used in vehicles on a racetrack. See Michigan Laws 207.1004 Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity. License: includes the whole or part of a governmental permit, certificate, approval, registration, charter, or similar form of permission required under a specific article of this act. See Michigan Laws 339.5105 Licensee: means a person that is issued a license under this act. See Michigan Laws 339.5105 Lien: A claim against real or personal property in satisfaction of a debt. Limitation: means a condition, stricture, constraint, restriction, or probation attached to a license that relates to the scope of practice of that occupation by the licensee. See Michigan Laws 339.5105 Limited heating service: means the servicing of gas-designed sectional boilers that have inputs of not more than 1 million British thermal units, utilizing a combustion safeguard designed to shut off the main gas supply 10 or more seconds after pilot flame failure, and all other gas-fired or solid-fuel equipment and systems limited to input ratings of less than 400,000 British thermal units per unit; or oil-fired equipment and systems designed for the use of number 1 or number 2 fuel oil, that has a maximum firing rate of less than 5 gallons per hour per unit; or electrical furnaces and electric boilers that use the same kilowatts that are equivalent to the fossil fuel British thermal units generated. See Michigan Laws 339.5803 Liquid: means any substance that is liquid in excess of 60 degrees Fahrenheit and a pressure of 14. See Michigan Laws 207.1004 Local governmental unit: means a city, village, or township. See Michigan Laws 207.601 Local governmental unit: means a county, township, city, village, or a metropolitan authority formed under the regional convention facility authority act, 2008 PA 554, MCL 141. See Michigan Laws 207.623 Local governmental unit: means a city, village, or township. See Michigan Laws 207.772 Low pressure boiler: means a steam boiler operated at pressures that do not exceed 15 p. See Michigan Laws 339.5903 Master electrician: means an individual who has the necessary qualifications, training, experience, and technical knowledge to supervise the installation of electrical wiring and equipment in accordance with the standard rules and regulations governing that work. See Michigan Laws 339.5703 Master plumber: means an individual who possesses the necessary skills and qualifications to plan and supervise the installation of plumbing and who is licensed as a master plumber. See Michigan Laws 339.6103 Michigan building code: means part 4 of the state construction code, R 408. See Michigan Laws 339.5107 Michigan electrical code: means part 8 of the state construction code, R 408. See Michigan Laws 339.5107 Michigan mechanical code: means part 9A of the state construction code, R 408. See Michigan Laws 339.5107 Michigan merit examination: means that examination developed under section 1279g of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 388.513 Michigan plumbing code: means part 7 of the state construction code, R 408. See Michigan Laws 339.5107 microgrid: means the lines, wires, fuel lines and fuel reformers, and controls to connect 2 or more alternative energy systems. See Michigan Laws 207.822 Microturbine energy system: means a system that generates electricity, composed of a compressor, combustor, turbine, and generator, fueled solely by a clean fuel with a capacity of not more than 250 kilowatts. See Michigan Laws 207.822 Miniturbine energy system: means a system that generates electricity, composed of a compressor, combustor, turbine, and generator, fueled solely by a clean fuel with a capacity of not more than 2 megawatts. See Michigan Laws 207.822 Minor repair: means a repair that involves only the clearance of stoppages, repair, or replacement of a faucet or valve or reinstallation of that same plumbing fixture and does not involve making any modifications to the plumbing system, or residential domestic water treatment and filtering equipment. See Michigan Laws 339.6103 Minor repair work: means electrical wiring that has a value of $100. See Michigan Laws 339.5703 Modified household income: means the gross annual income from all sources and before taxes or withholding of all individuals of a household living in a residential dwelling unit or housing unit after deducting all of the following:
(i) Unusual or temporary income of any member of the household. See Michigan Laws 207.902month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 8.3j Mortgage: The written agreement pledging property to a creditor as collateral for a loan. Mortgagee: The person to whom property is mortgaged and who has loaned the money. Motor fuel: means gasoline, diesel fuel, kerosene, a mixture of gasoline, diesel fuel, or kerosene, or a mixture of gasoline, diesel fuel, or kerosene and any other substance. See Michigan Laws 207.1004 Motor vehicle: means a motor vehicle subject to registration and certificate of title under section 216 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 207.751 Motor vehicle: means a vehicle that is propelled by an internal combustion engine or motor and is designed to permit the vehicle's mobile use on the public roads or highways of this state. See Michigan Laws 207.1004 Multifamily residential use: means multifamily housing consisting of 5 or more units. See Michigan Laws 207.842 Multimodal commerce: means the movement of products or services via 2 of the following:
(i) Air. See Michigan Laws 207.803Municipality: means a city, village, or township. See Michigan Laws 339.5107 Net gallons: means the remaining product, after all considerations and deductions have been made, measured in gallons, corrected to a temperature of 60 degrees Fahrenheit, 13 degrees Celsius, and a pressure of 14. See Michigan Laws 207.1004 New capital investment: means 1 or more of the following:
(i) New construction. See Michigan Laws 207.803New construction: means property not in existence on the date the authorized business enters into a written agreement with the authority and not replacement construction. See Michigan Laws 207.803 New facility: means a new structure which will have as its primary purpose multifamily housing consisting of 5 or more units and will be constructed in a downtown development district established pursuant to Act No. See Michigan Laws 207.601 New facility: means 1 or both of the following:
(i) A new structure or a portion of a new structure that has as its primary purpose residential housing consisting of 1 or 2 units, 1 of which is or will be occupied by an owner as his or her principal residence. See Michigan Laws 207.772New facility: means attainable housing property newly constructed on or after the effective date of this act. See Michigan Laws 207.902 new personal property: means personal property that is not subject to or that is exempt from the collection of taxes under the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.803 New residential facility: means residential housing property newly constructed on or after the effective date of this act. See Michigan Laws 207.952 Oath: A promise to tell the truth. oath: shall be construed to include the word "affirmation" in all cases where by law an affirmation may be substituted for an oath; and in like cases the word "sworn" shall be construed to include the word "affirmed". See Michigan Laws 8.3k Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period. Occupation: means a field of endeavor regulated under this act. See Michigan Laws 339.5107 Out-of-state college: means a state university, community college, or independent nonprofit degree-granting college or university that is located in another state and that is legally established under the laws of that other state. See Michigan Laws 388.513 Outline lighting: means an arrangement of incandescent lamps or electric discharge tubing that is an integral part of an electrical sign that outlines certain features, such as the shape of a building or the decoration of a window. See Michigan Laws 339.5703 Oversight: Committee review of the activities of a Federal agency or program. Owner: means the record title holder of, or the vendee of the original land contract pertaining to, a new facility, a homestead facility, or a rehabilitated facility for which a neighborhood enterprise zone certificate is applied for or issued. See Michigan Laws 207.772 Oxygenate: means an oxygen-containing, ashless, organic compound, such as an alcohol or ether, which may be used as a fuel or fuel supplement. See Michigan Laws 207.1004 Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses. Permissive supplier: means a person who may not be subject to the taxing jurisdiction of this state but who does meet both of the following requirements:
(i) Is a position holder in a federally registered terminal located outside of this state, or a person who acquires from a position holder motor fuel in an out-of-state terminal in a transaction that otherwise qualifies as a 2-party exchange under this act. See Michigan Laws 207.1004Person: means a natural person, partnership, limited partnership, fiduciary, association, corporation, limited liability company, or other entity. See Michigan Laws 207.623 Person: means an individual, partnership, corporation, association, or other legal entity. See Michigan Laws 207.751 Person: means an individual, partnership, corporation, limited liability company, association, governmental entity, or other legal entity. See Michigan Laws 207.822 Person: means and includes an individual, cooperative, partnership, firm, association, limited liability company, limited liability partnership, joint stock company, syndicate, and corporation, both private and municipal, and any receiver, trustee, conservator, or any other officer having jurisdiction and control of property by law or by appointment of a court other than units of government. See Michigan Laws 207.1004 Person: means an individual, sole proprietorship, partnership, association, limited liability company, corporation, or common law trust or a combination of those legal entities. See Michigan Laws 339.5107 person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l Personal property: All property that is not real property. Photovoltaic energy system: means a solar energy device composed of 1 or more photovoltaic cells or photovoltaic modules and an inverter or other power conditioning unit. See Michigan Laws 207.822 Plan: means a drinking water management plan created under section 5. See Michigan Laws 380.1903 Plan reviewer: means an individual who is engaged in the practice of examining construction documents for the purpose of determining compliance with applicable codes. See Michigan Laws 339.6003 Plumbing: means the practice, materials, and fixtures, in or adjacent to a building, structure, or premises, used in the installation, maintenance, extension, or alteration of all piping, fixtures, plumbing appliances, or plumbing appurtenances, as defined in the state construction code, in connection with the sanitary drainage or storm drainage facilities, plumbing venting systems, medical gas systems, backflow preventers, and public or private water supply systems. See Michigan Laws 339.6103 Plumbing contractor: means a licensed master plumber or a person who employs a licensed master plumber full-time to directly supervise the installation of plumbing as his or her representative engaged in the business of plumbing for a fixed sum, price, fee percentage, valuable consideration, or other compensation and who is licensed as a plumbing contractor. See Michigan Laws 339.6103 Position holder: means a person who has a contract with a terminal operator for the use of storage facilities and other terminal services for motor fuel at the terminal, as reflected in the records of the terminal operator. See Michigan Laws 207.1004 Power boiler: means a closed vessel in which steam or other vapor is generated at a pressure of more than 15 p. See Michigan Laws 339.5903 Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way. Process boiler: means a boiler that is operated at a pressure or temperature from which more than 10% of the boiler's capacity is used for direct steam humidification or direct process work. See Michigan Laws 339.5903 Process piping: means any piping which is not part of a system designed to provide air conditioning or of a refrigeration system. See Michigan Laws 339.5803 Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government. Provisional registration: means a building official, plan reviewer, or inspector who is registered subject to his or her completion of the amount of training, education, and experience required by the commission and the appropriate advisory board and described in section 1007(2). See Michigan Laws 339.6003 Public access: means the right of a person to view and copy files under the freedom of information act, 1976 PA 442, MCL 15. See Michigan Laws 339.5107 Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide. Public roads or highways: means a road, street, or place maintained by this state or a political subdivision of this state and generally open to use by the public as a matter of right for the purpose of vehicular travel, notwithstanding that they may be temporarily closed or travel is restricted for the purpose of construction, maintenance, repair, or reconstruction. See Michigan Laws 207.1004 Public-private arrangement: means a public-private arrangement authorized under the regional convention facility authority act, 2008 PA 554, MCL 141. See Michigan Laws 207.623 Qualified assessing authority: means 1 of the following:
(i) For a facility other than a homestead facility, the commission. See Michigan Laws 207.772qualified city: means that term as defined in section 5 of the regional convention facility authority act, 2008 PA 554, MCL 141. See Michigan Laws 207.629 Qualified downtown revitalization district: means an area located within 1 or more of the following:
(i) The boundaries of a downtown district as defined in section 201 of the recodified tax increment financing act, 2018 PA 57, MCL 125. See Michigan Laws 207.772Qualified facility: means a qualified retail food establishment or a building or group of contiguous buildings of commercial property that is 15 years old or older or has been allocated for a new markets tax credit under section 45D of the internal revenue code, 26 USC 45D. See Michigan Laws 207.842 Qualified facility: means a new facility or a rehabilitated facility, located in an attainable housing district. See Michigan Laws 207.902 Qualified high-technology business: means a business or facility whose primary business activity is high-technology activity or a qualified high-wage activity. See Michigan Laws 207.803 Qualified high-wage activity: means a business that has an average wage of 300% or more of the federal minimum wage. See Michigan Laws 207.803 Qualified historic building: means a property within a neighborhood enterprise zone that has been designated a historic resource as defined under section 266 of the income tax act of 1967, 1967 PA 281, MCL 206. See Michigan Laws 207.772 qualified local governmental unit: means , except as otherwise provided in this subsection, a city, village, township, county, or authority that is located in, or includes within its territory or jurisdiction, a county in which convention hotels are located and that either is the owner or lessee of a convention facility with 350,000 square feet or more of total exhibit space on July 30, 1985 or, if such a convention facility does not exist, will be the owner or lessee of a convention facility with 350,000 square feet or more of total exhibit space through the application of distributions under this section to the purchase or lease of a convention facility. See Michigan Laws 207.629 Qualified local governmental unit: means a city, village, or township. See Michigan Laws 207.842 Qualified local governmental unit: means a city, village, or township. See Michigan Laws 207.902 Qualified local governmental unit: means a city, village, or township. See Michigan Laws 207.952 Qualified lodging facility: means 1 or more of the following:
(i) Lodging facilities that constitute a portion of a tourism attraction facility and represent less than 50% of the total cost of the tourism attraction facility, or the lodging facilities are to be located on recreational property owned or leased by the municipal, state, or federal government. See Michigan Laws 207.803Qualified new job: means 1 of the following:
(i) A full-time job created by an authorized business at a facility that is in excess of the number of full-time jobs the authorized business maintained in this state prior to the expansion or location, as determined by the authority. See Michigan Laws 207.803Qualified residential facility: means a new residential facility or a rehabilitated residential facility, located in a residential housing district. See Michigan Laws 207.952 Qualified retail food establishment: means property that meets all of the following:
(i) The property will be used primarily as a retail supermarket, grocery store, produce market, or delicatessen that offers unprocessed USDA-inspected meat and poultry products or meat products that carry the USDA organic seal, fresh fruits and vegetables, and dairy products for sale to the public. See Michigan Laws 207.842Qualified technical education program: means an educational program that is approved by the board and that has a minimum of 350 contact hours in classroom hands-on training, field training, or supervised plant visits for high pressure boiler operators. See Michigan Laws 339.5903 Qualified training program: means any of the following:
(i) An in-house training program approved by the board and offered to boiler operators and stationary engineers by an employer. See Michigan Laws 339.5903Qualifying score: means a score on a readiness assessment or the Michigan merit examination that has been determined by the superintendent of public instruction to indicate readiness to enroll in a postsecondary course in that subject area under this act. See Michigan Laws 388.513 Quorum: The number of legislators that must be present to do business. Rack: means a mechanism for delivering motor fuel from a refinery, a terminal, or a marine vessel into a railroad tank car, a transport truck, a tank wagon, the fuel supply tank of a marine vessel, or other means of transfer outside of the bulk transfer/terminal system. See Michigan Laws 207.1005 Rate: means the cost of insurance per payroll before adjustment for an individual insured's size, exposure, or loss experience. See Michigan Laws 500.2402 Readiness assessment: means assessment instruments that are aligned with state learning standards; that are used nationally to provide high school students with an early indication of college readiness proficiency in English, mathematics, reading, social studies, and science and may contain a comprehensive career planning program; and that are approved by the superintendent of public instruction for the purposes of this act. See Michigan Laws 388.513 Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land. Refiner: means a person who owns, operates, or otherwise controls a refinery within the United States. See Michigan Laws 207.1005 Refinery: means a facility used to produce motor fuel from crude oil, unfinished oils, natural gas liquids, or other hydrocarbons and from which motor fuel may be removed by pipeline, by marine vessel, or at a rack. See Michigan Laws 207.1005 Refrigeration: means the use of equipment and systems, including, but not limited to, refrigeration piping, employing the refrigeration cycle to generate low temperatures for other than air conditioning equipment and systems. See Michigan Laws 339.5803 Regenerative hydraulic drive system: means a system that captures energy from nonparasitic vehicle sources or energy wasted by a vehicle's brakes or suspension to be released to directly assist vehicle propulsion or directly propel the vehicle. See Michigan Laws 207.822 Registered: means a building official, plan reviewer, inspector, fire protection system inspector, or fire protection system plan reviewer who is registered under this article. See Michigan Laws 339.6003 Rehabilitated facility: means , except as otherwise provided in section 2a, an existing structure or a portion of an existing structure with a current true cash value of $120,000. See Michigan Laws 207.772 Rehabilitated facility: means existing attainable housing property that has been renovated, with a renovation investment of not less than $5,000. See Michigan Laws 207.902 Rehabilitated residential facility: means existing residential housing property that has been renovated, with a renovation investment of not less than $50,000. See Michigan Laws 207.952 Rehabilitation: means changes to a qualified facility that are required to restore or modify the property, together with all appurtenances, to an economically efficient condition. See Michigan Laws 207.842 Related wiring: means any of the following:
(i) Except as otherwise provided in subparagraphs (i), (ii), (iii), and (iv), that portion of the electric sign wiring that originates at the load-side terminals of a disconnecting means located in the vicinity of the electric sign involved but does not include the installation of the disconnecting means, complete with line-side connections. See Michigan Laws 339.5703Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant. removed: means a physical transfer other than by evaporation, loss, or destruction of motor fuel from a terminal, manufacturing plant, customs custody, pipeline, marine vessel, or refinery that stores motor fuel. See Michigan Laws 207.1005 Renewable fuels: means 1 or more of the following:
(i) Biodiesel or biodiesel blends containing at least 20% biodiesel. See Michigan Laws 207.822Replacement construction: means that term as defined in section 34d(1)(b)(v) of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.803 Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation. Residential housing property: means that portion of real property not occupied by an owner of that real property, that is used for residential purposes, is rented or leased to an income-qualified household at no more than 30% of the household's modified household income as determined by the qualified local governmental unit, and is either a multiple-unit dwelling of more than 4 units or a dwelling unit in a multiple-purpose structure of more than 4 dwelling units. See Michigan Laws 207.952 Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action. Retained jobs: means the number of full-time jobs at a facility of an authorized business maintained in this state on a specific date as that date and number of jobs is determined by the authority. See Michigan Laws 207.803 revised school code: means the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 380.1895 Room charge: means the charge imposed for the use or occupancy of accommodations, excluding charges for food, beverages, telephone services, the use tax imposed under the use tax act, 1937 PA 94, MCL 205. See Michigan Laws 207.623 Rule: means a rule promulgated under the administrative procedures act of 1969. See Michigan Laws 339.5107 Rural business: means an eligible business located in a county with a population of 90,000 or less. See Michigan Laws 207.803 School: means a public school or nonpublic school as those terms are defined in section 5 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 380.1903 School district: means that term as defined in section 6 of the revised school code, MCL 380. See Michigan Laws 380.1895 School district: means that term as defined in section 6 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 388.513 seal: shall be construed to include any of the following:
(a) The impression of the seal on the paper alone. See Michigan Laws 8.3nService area: means that term as defined in section 3501, unless the context requires otherwise. See Michigan Laws 500.116 Servicing: means the maintenance, repair, and servicing of previously installed equipment and systems. See Michigan Laws 339.5803 Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims. shall not apply: means that the pertinent provision is not operative as to certain persons or things or in conjunction with a particular date or dates. See Michigan Laws 8.4c Sign specialist: means an individual who, as his or her principal occupation, is engaged in the installation, alteration, or repair of electric signs. See Michigan Laws 339.5703 Sign specialty contractor: means a person that is engaged in the business of manufacturing, installing, maintaining, connecting, or repairing electric sign wiring or devices, including wiring that is directly related to electric signs and is electrically dedicated as a sign circuit. See Michigan Laws 339.5703 Sign specialty licensure: means licensure as a sign specialist or sign specialty contractor. See Michigan Laws 339.5703 Small-scale: means 1 or more of the following:
(i) A single energy system with a generating capacity of not more than 2 megawatts or an integrated energy system with a generating capacity of not more than 10 megawatts. See Michigan Laws 207.822solar vehicle: means a motor vehicle powered solely by a photovoltaic energy system. See Michigan Laws 207.822 specific tax: means the specific tax levied under this act. See Michigan Laws 207.902 specific tax: means the specific tax levied under this act. See Michigan Laws 207.952 Stadium: means a facility, including necessary sites, related parking lots or structures, and appurtenant properties and facilities, that is intended to provide space for any of the following:
(i) A professional baseball franchise, if the facility itself contains not less than 25,000 seats and is located in the downtown area of the most populous city in the eligible county. See Michigan Laws 207.751state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o State approved nonpublic school: means that term as defined in section 6 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 388.513 State construction code: means the rules promulgated by the state construction code commission under section 4 of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5107 State university: means a state institution of higher education described in section 4, 5, or 6 of article VIII of the state constitution of 1963. See Michigan Laws 388.513 station: means an apparatus that meets all of the following requirements:
(i) Is connected to customer site piping. See Michigan Laws 380.1903Stationary engine: means a temporary or permanently affixed engine designed and used to supply power primarily for agricultural or construction work. See Michigan Laws 207.1005 stationary engineer: means an individual who is engaged in the operation of boilers and associated auxiliaries. See Michigan Laws 339.5901 Statute: A law passed by a legislature. Statute of limitations: A law that sets the time within which parties must take action to enforce their rights. Stille-DeRossett-Hale single state construction code act: means 1972 PA 230, MCL 125. See Michigan Laws 339.5107 Stirling cycle energy system: means a closed-cycle, regenerative heat engine that is fueled solely by a clean fuel and uses an external combustion process, heat exchangers, pistons, a regenerator, and a confined working gas, such as hydrogen or helium, to convert heat into mechanical energy. See Michigan Laws 207.822 Subpoena: A command to a witness to appear and give testimony. subscriber: means an individual who enters into an insurance contract for health insurance, or on whose behalf an insurance contract for health insurance is entered into, with an insurer. See Michigan Laws 500.116 Subsidiary business: means a business that is directly or indirectly controlled or at least 80% owned by an authorized business. See Michigan Laws 207.803 Superintendent: means the superintendent of public instruction of the state department of education. See Michigan Laws 388.382 Tank wagon: means a straight truck having 1 or more compartments other than the fuel supply tank designed or used to carry motor fuel. See Michigan Laws 207.1006 Tax: means a tax, interest, or penalty levied under this act. See Michigan Laws 207.1006 Taxable value: means the value determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.842 Taxable value: means the value determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.902 Taxable value: means the value determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 207.952 Terminal: means a motor fuel storage and distribution facility that meets all of the following requirements:
(i) Is registered as a qualified terminal by the internal revenue service. See Michigan Laws 207.1006Terminal operator: means a person who owns, operates, or otherwise controls a terminal. See Michigan Laws 207.1006 Testify: Answer questions in court. Thermoelectric energy system: means a system that generates energy by converting thermal energy into electrical energy using direct heat from a clean fuel energy system or waste heat from any source. See Michigan Laws 207.822 Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident. Tourism attraction facility: means a cultural or historical site, a recreation or entertainment facility, an area of natural phenomena or scenic beauty, or an entertainment destination center as determined by the Michigan economic growth authority as follows:
(i) In making a determination, the Michigan economic growth authority shall consider all of the following:
(A) Whether the facility will actually attract tourists. See Michigan Laws 207.803Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition. Transmix: means the mixed product that results from the buffer or interface of 2 different products in a pipeline shipment, or a mixture of 2 different products within a refinery or terminal that results in an off-grade mixture. See Michigan Laws 207.1006 Transport truck: means a semitrailer combination rig designed or used for the purpose of transporting motor fuel over the public roads or highways. See Michigan Laws 207.1006 Transporter: means an operator of a railroad or rail car, tank wagon, transport truck, or other fuel transportation vehicle engaged in the business of transporting motor fuel below the terminal rack. See Michigan Laws 207.1006 Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence. Trustee: A person or institution holding and administering property in trust. Ultimate vendor: means the person who sells motor fuel to the end user of the fuel. See Michigan Laws 207.1006 Underserved area: means an area determined by the Michigan department of agriculture that contains a low or moderate income census tract and a below average supermarket density, an area that has a supermarket customer base with more than 50% living in a low income census tract, or an area that has demonstrated significant access limitations due to travel distance. See Michigan Laws 207.842 Uniformed services: means the Commissioned Corps of the United States Public Health Service and the National Oceanic and Atmospheric Administration Commissioned Officer Corps. See Michigan Laws 339.5107 United States: shall be construed to include the district and territories. See Michigan Laws 8.3o Unlimited heating service: means the servicing of heating equipment and systems without restrictions concerning thermal capacity or grade of fuel oil or type of fuel. See Michigan Laws 339.5803 Unlimited refrigeration and air conditioning service: means the servicing of refrigeration equipment and systems and air conditioning equipment and systems employing the refrigeration cycle unlimited as to thermal capacity or type of refrigerant. See Michigan Laws 339.5803 Veteran: means that term as defined in section 1 of 1965 PA 190, MCL 35. See Michigan Laws 339.5107 Water service pipe: means the pipe from the water main or other source of potable water supply to the water distributing system of the building served. See Michigan Laws 339.6103 Wholesaler: means a person who acquires motor fuel from a supplier or from another wholesaler for subsequent sale and distribution at wholesale by a fuel transportation vehicle, rail car, or other motor vehicle. See Michigan Laws 207.1006 Wind energy system: means an integrated unit consisting of a wind turbine composed of a rotor, an electrical generator, a control system, an inverter or other power conditioning unit, and a tower, which uses moving air to produce power. See Michigan Laws 207.822 Written agreement: means a written agreement made pursuant to section 8. See Michigan Laws 207.803
