Terms Used In Michigan Laws 339.2677

  • Appraisal: A determination of property value.
  • Appraisal: means that term as defined in section 2601. See Michigan Laws 339.2661
  • Appraisal management company: means a person that provides appraisal management services. See Michigan Laws 339.2661
  • Appraiser: means that term as defined in section 2601. See Michigan Laws 339.2661
  • Appraiser panel: means a network, list, or roster of licensed or certified appraisers approved by an appraisal management company to perform appraisals as independent contractors for the appraisal management company. See Michigan Laws 339.2661
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 8.3q
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories.   • Uniform standards of professional appraisal practice: means that term as defined in section 2601. See Michigan Laws 339.2661
    (1) An appraisal management company shall not remove an appraiser from its appraiser panel, or otherwise refuse to assign requests for real estate appraisal services to an independent appraiser, without doing all of the following:
    (a) Not less than 10 business days before the removal of the appraiser, notifying the appraiser in writing of all of the following, as applicable:
    (i) The reasons why the appraiser will be removed from the panel.
    (ii) If the appraiser will be removed from the panel for illegal conduct, a violation of the uniform standards of professional appraisal practice, or a violation of state licensing standards, the nature of the alleged conduct or violation.
    (b) Providing an opportunity for the appraiser to respond to the company’s notification or notifications under subdivision (a).
    (2) If an appraisal management company removes an independent appraiser from its appraiser panel for alleged illegal conduct, an alleged violation of the uniform standards of professional appraisal practice, or an alleged violation of state licensing standards, the appraiser may file a complaint with the department for a review of the decision of the appraisal management company. In its consideration of the complaint, the department may not make any determination regarding the nature of the business relationship between the appraiser and the appraisal management company that is unrelated to the alleged conduct or violation.
