Terms Used In Michigan Laws 339.5923

  • Board: means the board of boiler rules described in section 905. See Michigan Laws 339.5901
  • Boiler: means a closed vessel in which water is heated, steam is generated, or steam is superheated, or a combination of those actions occurs, under pressure or vacuum by the application of heat from combustible fuels, electricity, or nuclear energy. See Michigan Laws 339.5901
  • Department: means the department of licensing and regulatory affairs. See Michigan Laws 339.5103
  • Director: means the director of the department of licensing and regulatory affairs or his or her authorized representative. See Michigan Laws 339.5103
  • experience: includes any relevant experience acquired while serving in the armed forces by an individual who was separated from that service if all of the following are met:
    (a) The applicant provides to the department a form DD214, a form DD215, or any other form that is satisfactory to the department that demonstrates that he or she was separated from that service, with an honorable character of service or under honorable conditions (general) character of service. See Michigan Laws 339.5903
  • License: includes the whole or part of a governmental permit, certificate, approval, registration, charter, or similar form of permission required under a specific article of this act. See Michigan Laws 339.5105
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  •     Subject to civil service rules, the director shall employ deputy inspectors who are responsible to the chief inspector. The department may only appoint an individual who meets all of the following as a deputy inspector:
        (a) At the time of appointment, has at least 5 years of experience in the inspection, construction, maintenance, repair, or operation of high pressure boilers as a mechanical engineer, steam operating engineer, boilermaker, or boiler inspector.
        (b) Has passed the deputy inspector examination under section 927 or meets either of the following:
        (i) Holds a license or a certificate of competency as an inspector of boilers for a state that has a standard of examination substantially equal to the standard of this state, as determined by the board.
        (ii) Holds a license as an inspector of boilers issued by the National Board of Boiler and Pressure Vessel Inspectors.
