Terms Used In Michigan Laws 333.10104
- Adult: means an individual who is at least 18 years of age. See Michigan Laws 333.10102
- Agent: means an individual who meets 1 or more of the following requirements:
(i) Is authorized to make health care decisions on the principal's behalf by a power of attorney for health care. See Michigan Laws 333.10102Anatomical gift: means a donation of all or part of a human body to take effect after the donor's death for the purpose of transplantation, therapy, research, or education. See Michigan Laws 333.10102 Body part: means an organ, eye, or tissue of a human being. See Michigan Laws 333.10102 Donor: The person who makes a gift. Donor: means an individual whose body or body part is the subject of an anatomical gift. See Michigan Laws 333.10102 Driver license: means an operator's or chauffeur's license or permit issued to an individual by the secretary of state under chapter III of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 333.10102 Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value. Identification card: means an official state personal identification card issued by the secretary of state under 1972 PA 222, MCL 28. See Michigan Laws 333.10102 Minor: means an individual who is under 18 years of age. See Michigan Laws 333.10102 Parent: means a parent whose parental rights have not been terminated. See Michigan Laws 333.10102 Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Subject to section 10108, an anatomical gift of a donor‘s body or body part may be made during the life of the donor for the purpose of transplantation, therapy, research, or education in the manner provided in section 10105 by any of the following:
(a) The donor, if the donor is an adult or if the donor is a minor and meets 1 or more of the following requirements:
(i) Is emancipated.
(ii) Has been issued a driver license or identification card because the donor is at least 16 years of age.
(b) An agent of the donor, unless the power of attorney for health care or other record prohibits the agent from making an anatomical gift.
(c) A parent of the donor, if the donor is an unemancipated minor.
(d) The donor’s guardian.
