- Bioterrorism: means :(1)(a) the intentional use of any microorganism, virus, infectious substance, or biological product to cause death, disease, or other biological malfunction in a human, an animal, a plant, or another living organism in order to influence, intimidate, or coerce the conduct of government or a civilian population; and(1)(b) includes anthrax, botulism, small pox, plague, tularemia, and viral hemorrhagic fevers. See Utah Code 26B-7-301
- Certified dietitian: means a person who is certified by the division as meeting the certification requirements provided in this chapter. See Utah Code 58-49-2
- Commission on Dietetic Registration: means the credentialing component of the American Dietetic Association. See Utah Code 58-49-2
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Cross examine: Questioning of a witness by the attorney for the other side.
- Dangerous public health condition: means any of the following:
(2)(a) cholera;(2)(b) pneumonic plague;(2)(c) severe acute respiratory syndrome;(2)(d) smallpox;(2)(e) tuberculosis;(2)(f) any viral hemorrhagic fever;(2)(g) measles; or(2)(h) any infection:(2)(h)(i) that is new, drug resistant, or reemerging;(2)(h)(ii) that evidence suggests is likely to cause either high mortality or morbidity; and(2)(h)(iii) only if the relevant legislative body of the county where the infection is located approves as needing containment. See Utah Code 26B-7-301- Department: means the Department of Commerce. See Utah Code 58-1-102
- Dietetics: includes :
(3)(a) the evaluation of a person's dietary status;(3)(b) the advising and education of persons on dietary needs; and(3)(c) the evaluation of needs, implementation of systems to support needs, and maintenance of appropriate standards of quality in food and dietary service for individuals, groups, or patients in licensed institutional facilities or in private office settings. See Utah Code 58-49-2- Division: means the Division of Professional Licensing created in Section
58-1-103 . See Utah Code 58-1-102- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Executive director: means the executive director of the department appointed under Section 26B-1-203. See Utah Code 26B-1-102
- First responder: means :
(6)(a) a law enforcement officer as defined in Section53-13-103 ;(6)(b) emergency medical service personnel as defined in Section26B-4-101 ;(6)(c) firefighters; and(6)(d) public health personnel having jurisdiction over the location where an individual subject to an order of restriction is found. See Utah Code 26B-7-301- Joint resolution: A legislative measure which requires the approval of both chambers.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Licensee: includes any holder of a license, certificate, registration, permit, student card, or apprentice card authorized under this title. See Utah Code 58-1-102
- Local food: means the same as that term is defined in Section
4-1-109 . See Utah Code 26B-7-301- Local health department: means the same as that term is defined in Section 26A-1-102. See Utah Code 26B-1-102
- Order of constraint: includes a stay-at-home order. See Utah Code 26B-7-301
- Order of restriction: means an order issued by a department or a district court which requires an individual or group of individuals who are subject to restriction to submit to an examination, treatment, isolation, or quarantine. See Utah Code 26B-7-301
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Public health emergency: includes an illness or health condition resulting from a natural disaster. See Utah Code 26B-7-301
- Public health official: means :
(13)(a) the executive director or the executive director's authorized representative; or(13)(b) the executive director of a local health department or the executive director's authorized representative. See Utah Code 26B-7-301- School: means a public, private, or parochial nursery school, licensed or unlicensed day care center, child care facility, family care home, Head Start program, kindergarten, elementary, or secondary school through grade 12. See Utah Code 26B-7-201
- Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Stay-at-home order: means an order of constraint that:
(15)(a) restricts movement of the general population to suppress or mitigate an epidemic or pandemic disease by directing individuals within a defined geographic area to remain in their respective residences; and(15)(b) may include exceptions for certain essential tasks. See Utah Code 26B-7-301- Threat to public health: means a situation where a dangerous public health condition could spread to other individuals. See Utah Code 26B-7-301
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
- Writing: includes :
(48)(a) printing;(48)(b) handwriting; and(48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5
