- Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
- Adjudicative proceeding: means :(2)(a) an action by a board, commission, department, officer, or other administrative unit of the state that determines the legal rights, duties, privileges, immunities, or other legal interests of one or more identifiable persons, including an action to grant, deny, revoke, suspend, modify, annul, withdraw, or amend an authority, right, or license; and(2)(b) judicial review of an action described in Subsection (2)(a). See Utah Code 68-3-12.5
- Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affiliate: means :
(1)(a) with respect to an individual:(1)(a)(i) a companion of the individual;(1)(a)(ii) a lineal ancestor or descendant, whether by blood or adoption, of:(1)(a)(ii)(A) the individual; or(1)(a)(ii)(B) a companion of the individual;(1)(a)(iii) a companion of an ancestor or descendant described in Subsection (1)(a)(ii);(1)(a)(iv) a sibling, aunt, uncle, great aunt, great uncle, first cousin, niece, nephew, grandniece, or grandnephew of the individual, whether related by the whole or the half blood or adoption, or a companion of a sibling, aunt, uncle, great aunt, great uncle, first cousin, niece, nephew, grandniece, or grandnephew of the individual; or(1)(a)(v) any other individual occupying the residence of the individual; and(1)(b) with respect to a person other than an individual:(1)(b)(i) another person that directly or indirectly controls, is controlled by, or is under common control with the person;(1)(b)(ii) an officer, director, manager, member, partner, employee, or trustee or other fiduciary of the person; or(1)(b)(iii) a companion of, or an individual occupying the residence of, an individual described in Subsection (1)(b)(i) or (ii). See Utah Code 78B-21-102- All-terrain type II vehicle: means the same as that term is defined in Section
41-22-2 . See Utah Code 41-6a-102 v2- All-terrain type III vehicle: means the same as that term is defined in Section
41-22-2 . See Utah Code 41-6a-102 v2- Alley: means a street or highway intended to provide access to the rear or side of lots or buildings in urban districts and not intended for through vehicular traffic. See Utah Code 41-6a-102
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appraisal: A determination of property value.
- Arbitration organization: means an association, agency, board, commission, or other entity that is neutral and initiates, sponsors, or administers an arbitration proceeding or is involved in the appointment of an arbitrator. See Utah Code 78B-11-102
- Arbitrator: means an individual appointed to render an award, alone or with others, in a controversy that is subject to an agreement to arbitrate. See Utah Code 78B-11-102
- Arrest: Taking physical custody of a person by lawful authority.
- Assessment: means an in-depth clinical interview with a licensed mental health therapist:
(1)(b)(i) used to determine if a person is in need of:(1)(b)(i)(A) substance abuse treatment that is obtained at a substance abuse program;(1)(b)(i)(B) an educational series; or(1)(b)(i)(C) a combination of Subsections (1)(b)(i)(A) and (B); and(1)(b)(ii) that is approved by the Division of Integrated Healthcare in accordance with Section26B-5-104 . See Utah Code 41-6a-501- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Authority board: means the board of directors of a local building authority, as described in Section 17D-2-203. See Utah Code 17D-2-102
- Authorized emergency vehicle: includes :
(3)(a) a fire department vehicle;(3)(b) a police vehicle;(3)(c) an ambulance; and(3)(d) other publicly or privately owned vehicles as designated by the commissioner of the Department of Public Safety. See Utah Code 41-6a-102- Autocycle: means the same as that term is defined in Section
53-3-102 . See Utah Code 41-6a-102- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Bicycle: includes an electric assisted bicycle. See Utah Code 41-6a-102
- Bond: includes a bond, note, or other instrument issued under this chapter evidencing an indebtedness of a local building authority. See Utah Code 17D-2-102
- Bus: means a motor vehicle:
(6)(a)(i) designed for carrying more than 15 passengers and used for the transportation of persons; or(6)(a)(ii) designed and used for the transportation of persons for compensation. See Utah Code 41-6a-102- City: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- Commissioner: means the commissioner of the Department of Public Safety. See Utah Code 41-6a-102
- Companion: means :
(2)(a) the spouse of an individual;(2)(b) the domestic partner of an individual; or(2)(c) another individual in a civil union with an individual. See Utah Code 78B-21-102- Contract: A legal written agreement that becomes binding when signed.
- Controlled-access highway: means a highway, street, or roadway:
(12)(a) designed primarily for through traffic; and(12)(b) to or from which owners or occupants of abutting lands and other persons have no legal right of access, except at points as determined by the highway authority having jurisdiction over the highway, street, or roadway. See Utah Code 41-6a-102- Conviction: A judgement of guilt against a criminal defendant.
- Conviction: means any conviction arising from a separate episode of driving for a violation of:
(2)(a)(i) driving under the influence under Section41-6a-502 ;(2)(a)(ii)(2)(a)(ii)(A) for an offense committed before July 1, 2008, alcohol, any drug, or a combination of both-related reckless driving under Sections41-6a-512 and41-6a-528 ; or(2)(a)(ii)(B) for an offense committed on or after July 1, 2008, impaired driving under SectionUtah Code 41-6a-501 - Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Court: means a court of competent jurisdiction in this state. See Utah Code 78B-11-102
- Court: means a court of this state with jurisdiction over the action under Title 78A, Judiciary and Judicial Administration. See Utah Code 78B-21-102
- Creating local entity: means the local entity that creates or created the local building authority. See Utah Code 17D-2-102
- Crosswalk: means :
(13)(a) that part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from:(13)(a)(i)(13)(a)(i)(A) the curbs; or(13)(a)(i)(B) in the absence of curbs, from the edges of the traversable roadway; and(13)(a)(ii) in the absence of a sidewalk on one side of the roadway, that part of a roadway included within the extension of the lateral lines of the existing sidewalk at right angles to the centerline; or(13)(b) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface. See Utah Code 41-6a-102- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Deed: The legal instrument used to transfer title in real property from one person to another.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Department: means the Department of Public Safety. See Utah Code 41-6a-102
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
- Divided highway: means a highway divided into two or more roadways by:
(16)(a) an unpaved intervening space;(16)(b) a physical barrier; or(16)(c) a clearly indicated dividing section constructed to impede vehicular traffic. See Utah Code 41-6a-102- Driving under the influence court: means a court that is approved as a driving under the influence court by the Judicial Council according to standards established by the Judicial Council. See Utah Code 41-6a-501
- drugs: means :
(1)(d)(i) a controlled substance as defined in Section58-37-2 ;(1)(d)(ii) a drug as defined in Section58-17b-102 ; or(1)(d)(iii) a substance that, when knowingly, intentionally, or recklessly taken into the human body, can impair the ability of a person to safely operate a motor vehicle. See Utah Code 41-6a-501- Echelon formation: means the operation of two or more snowplows arranged side-by-side or diagonally across multiple lanes of traffic of a multi-lane highway to clear snow from two or more lanes at once. See Utah Code 41-6a-102
- Educational series: means an educational series obtained at a substance abuse program that is approved by the Division of Integrated Healthcare in accordance with Section
26B-5-104 . See Utah Code 41-6a-501- Electric assisted bicycle: means a bicycle with an electric motor that:
(18)(a)(i) has a power output of not more than 750 watts;(18)(a)(ii) has fully operable pedals;(18)(a)(iii) has permanently affixed cranks that were installed at the time of the original manufacture;(18)(a)(iv) is fully operable as a bicycle without the use of the electric motor; and(18)(a)(v) is one of the following:(18)(a)(v)(A) a class 1 electric assisted bicycle;(18)(a)(v)(B) a class 2 electric assisted bicycle;(18)(a)(v)(C) a class 3 electric assisted bicycle; or(18)(a)(v)(D) a programmable electric assisted bicycle. See Utah Code 41-6a-102- Electric personal assistive mobility device: means a self-balancing device with:
(19)(a)(i) two nontandem wheels in contact with the ground;(19)(a)(ii) a system capable of steering and stopping the unit under typical operating conditions;(19)(a)(iii) an electric propulsion system with average power of one horsepower or 750 watts;(19)(a)(iv) a maximum speed capacity on a paved, level surface of 12. See Utah Code 41-6a-102- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Farm tractor: means a motor vehicle designed and used primarily as a farm implement, for drawing plows, mowing machines, and other implements of husbandry. See Utah Code 41-6a-102
- Fiduciary: A trustee, executor, or administrator.
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
- Fraud: Intentional deception resulting in injury to another.
- Freeway: means a controlled-access highway that is part of the interstate system as defined in Section
72-1-102 . See Utah Code 41-6a-102- Golf cart: means a device that:
(24)(a)(i) is designed for transportation by players on a golf course;(24)(a)(ii) has not less than three wheels in contact with the ground;(24)(a)(iii) has an unladen weight of less than 1,800 pounds;(24)(a)(iv) is designed to operate at low speeds; and(24)(a)(v) is designed to carry not more than six persons including the driver. See Utah Code 41-6a-102- Gore area: means the area delineated by two solid white lines that is between a continuing lane of a through roadway and a lane used to enter or exit the continuing lane including similar areas between merging or splitting highways. See Utah Code 41-6a-102
- Governing body: means :
(4)(a) for a county, city, or town, the legislative body of the county, city, or town;(4)(b) for a school district, the local school board for the school district;(4)(c) for a special district, the special district's board of trustees; and(4)(d) for a special service district, the special service district's governing body, as defined in Section 17D-1-102. See Utah Code 17D-2-102- Governmental unit: means an office, department, division, bureau, board, commission, or other agency of this state or a subdivision of this state. See Utah Code 78B-21-102
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Guardian: includes a person who:
(14)(a) qualifies as a guardian of a minor or incapacitated person pursuant to testamentary or court appointment; or(14)(b) is appointed by a court to manage the estate of a minor or incapacitated person. See Utah Code 68-3-12.5- Hi-rail vehicle: means a roadway maintenance vehicle that is:
(27)(a) manufactured to meet Federal Motor Vehicle Safety Standards; and(27)(b) equipped with retractable flanged wheels that allow the vehicle to travel on a highway or railroad tracks. See Utah Code 41-6a-102- Highway: means the entire width between property lines of every way or place of any nature when any part of it is open to the use of the public as a matter of right for vehicular travel. See Utah Code 41-6a-102
- Highway authority: means the same as that term is defined in Section
72-1-102 . See Utah Code 41-6a-102- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Intersection: means the area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two or more highways that join one another. See Utah Code 41-6a-102
- Island: means an area between traffic lanes or at an intersection for control of vehicle movements or for pedestrian refuge designated by:
(31)(a) pavement markings, which may include an area designated by two solid yellow lines surrounding the perimeter of the area;(31)(b) channelizing devices;(31)(c) curbs;(31)(d) pavement edges; or(31)(e) other devices. See Utah Code 41-6a-102- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Knowledge: means actual knowledge. See Utah Code 78B-11-102
- Land: includes :
(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5- Lane filtering: means , when operating a motorcycle other than an autocycle, the act of overtaking and passing another vehicle that is stopped in the same direction of travel in the same lane. See Utah Code 41-6a-102
- Law enforcement agency: means the same as that term is as defined in Section
53-1-102 . See Utah Code 41-6a-102- Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Lien: A claim against real or personal property in satisfaction of a debt.
- Lien: means an interest in property that secures payment or performance of an obligation. See Utah Code 78B-21-102
- Limited access highway: means a highway:
(34)(a) that is designated specifically for through traffic; and(34)(b) over, from, or to which neither owners nor occupants of abutting lands nor other persons have any right or easement, or have only a limited right or easement of access, light, air, or view. See Utah Code 41-6a-102- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Local entity: means a county, city, town, school district, special district, or special service district. See Utah Code 17D-2-102
- Local highway authority: means the legislative, executive, or governing body of a county, municipal, or other local board or body having authority to enact laws relating to traffic under the constitution and laws of the state. See Utah Code 41-6a-102
- Low-speed vehicle: means a four wheeled electric motor vehicle that:
(36)(a)(i) is designed to be operated at speeds of not more than 25 miles per hour; and(36)(a)(ii) has a capacity of not more than six passengers, including a conventional driver or fallback-ready user if on board the vehicle, as those terms are defined in SectionUtah Code 41-6a-102 - Mobile home: means :
(39)(a) a trailer or semitrailer that is:(39)(a)(i) designed, constructed, and equipped as a dwelling place, living abode, or sleeping place either permanently or temporarily; and(39)(a)(ii) equipped for use as a conveyance on streets and highways; or(39)(b) a trailer or a semitrailer whose chassis and exterior shell is designed and constructed for use as a mobile home, as defined in Subsection (39)(a), but that is instead used permanently or temporarily for:(39)(b)(i) the advertising, sale, display, or promotion of merchandise or services; or(39)(b)(ii) any other commercial purpose except the transportation of property for hire or the transportation of property for distribution by a private carrier. See Utah Code 41-6a-102- Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
- Moped: means a motor-driven cycle having:
(41)(a)(i) pedals to permit propulsion by human power; and(41)(a)(ii) a motor that:(41)(a)(ii)(A) produces not more than two brake horsepower; and(41)(a)(ii)(B) is not capable of propelling the cycle at a speed in excess of 30 miles per hour on level ground. See Utah Code 41-6a-102- Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
- Mortgage: means a record, however denominated, that creates or provides for a consensual lien on real property or rents, even if the mortgage also creates or provides for a lien on personal property. See Utah Code 78B-21-102
- Mortgage: means any instrument under which property may be encumbered as security for an obligation, including a mortgage, trust deed, indenture, pledge, assignment, security agreement, and financing statement. See Utah Code 17D-2-102
- Mortgagee: The person to whom property is mortgaged and who has loaned the money.
- Mortgagee: means a person entitled to enforce an obligation secured by a mortgage. See Utah Code 78B-21-102
- Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
- Mortgagor: means a person that grants a mortgage or a successor in ownership of the real property described in the mortgage. See Utah Code 78B-21-102
- Motor assisted scooter: means a self-propelled device with:
(42)(a)(i) at least two wheels in contact with the ground;(42)(a)(ii) a braking system capable of stopping the unit under typical operating conditions;(42)(a)(iii) an electric motor not exceeding 2,000 watts;(42)(a)(iv) either:(42)(a)(iv)(A) handlebars and a deck design for a person to stand while operating the device; or(42)(a)(iv)(B) handlebars and a seat designed for a person to sit, straddle, or stand while operating the device;(42)(a)(v) a design for the ability to be propelled by human power alone; and(42)(a)(vi) a maximum speed of 20 miles per hour on a paved level surface. See Utah Code 41-6a-102- Motor vehicle: means a vehicle that is self-propelled and a vehicle that is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. See Utah Code 41-6a-102
- motor vehicle: includes :
(1)(m)(ii)(A) an off-highway vehicle as defined under Section41-22-2 ; and(1)(m)(ii)(B) a motorboat as defined in Section73-18-2 . See Utah Code 41-6a-501- Motor-driven cycle: means a motorcycle, moped, and a motorized bicycle having:
(45)(a)(i) an engine with less than 150 cubic centimeters displacement; or(45)(a)(ii) a motor that produces not more than five horsepower. See Utah Code 41-6a-102- Motorcycle: means :
(44)(a) a motor vehicle, other than a tractor, having a seat or saddle for the use of the rider and designed to travel with not more than three wheels in contact with the ground; or(44)(b) an autocycle. See Utah Code 41-6a-102- Negligence: means simple negligence, the failure to exercise that degree of care that an ordinarily reasonable and prudent person exercises under like or similar circumstances. See Utah Code 41-6a-501
- Novice learner driver: means an individual who:
(1)(h)(i) has applied for a Utah driver license;(1)(h)(ii) has not previously held a driver license in this state or another state; and(1)(h)(iii) has not completed the requirements for issuance of a Utah driver license. See Utah Code 41-6a-501- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Off-highway vehicle: means the same as that term is defined under Section
41-22-2 . See Utah Code 41-6a-102- Operate: means the same as that term is defined in Section
41-1a-102 . See Utah Code 41-6a-102- Operator: means :
(49)(a) a human driver, as defined in SectionUtah Code 41-6a-102 - Oversight: Committee review of the activities of a Federal agency or program.
- Owner: means the person for whose property a receiver is appointed. See Utah Code 78B-21-102
- parking: means the standing of a vehicle, whether the vehicle is occupied or not. See Utah Code 41-6a-102
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Peace officer: means a peace officer authorized under Title 53, Chapter 13, Peace Officer Classifications, to direct or regulate traffic or to make arrests for violations of traffic laws. See Utah Code 41-6a-102
- Pedestrian: means a person traveling:
(53)(a) on foot; or(53)(b) in a wheelchair. See Utah Code 41-6a-102- Pedestrian traffic-control signal: means a traffic-control signal used to regulate pedestrians. See Utah Code 41-6a-102
- Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, government, governmental subdivision, agency, or instrumentality, public corporation, or any other legal or commercial entity. See Utah Code 78B-11-102
- Person: means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency, or instrumentality, or other legal entity. See Utah Code 78B-21-102
- Person: means a natural person, firm, copartnership, association, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, governmental agency, public corporation, or any other legal or commercial entity. See Utah Code 41-6a-102
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Personal property: All property that is not real property.
- Personal property: includes :
(25)(a) money;(25)(b) goods;(25)(c) chattels;(25)(d) effects;(25)(e) evidences of a right in action;(25)(f) a written instrument by which a pecuniary obligation, right, or title to property is created, acknowledged, transferred, increased, defeated, discharged, or diminished; and(25)(g) a right or interest in an item described in Subsections (25)(a) through (f). See Utah Code 68-3-12.5- Plaintiff: The person who files the complaint in a civil lawsuit.
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Pole trailer: means a vehicle without motive power:
(56)(a) designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach, or pole, or by being boomed or otherwise secured to the towing vehicle; and(56)(b) that is ordinarily used for transporting long or irregular shaped loads including poles, pipes, or structural members generally capable of sustaining themselves as beams between the supporting connections. See Utah Code 41-6a-102- Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
- Private law: A private bill enacted into law. Private laws have restricted applicability, often addressing immigration and naturalization issues affecting individuals.
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Proceeds: means the following property:
(12)(a) whatever is acquired on the sale, lease, license, exchange, or other disposition of receivership property;(12)(b) whatever is collected on, or distributed on account of, receivership property;(12)(c) rights arising out of receivership property;(12)(d) to the extent of the value of receivership property, claims arising out of the loss, nonconformity, or interference with the use of, defects or infringement of rights in, or damage to the property; or(12)(e) to the extent of the value of receivership property and to the extent payable to the owner or mortgagee, insurance payable by reason of the loss or nonconformity of, defects or infringement of rights in, or damage to the property. See Utah Code 78B-21-102- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Programmable electric assisted bicycle: means an electric assisted bicycle with capability to switch or be programmed to function as a class 1 electric assisted bicycle, class 2 electric assisted bicycle, or class 3 electric assisted bicycle, provided that the electric assisted bicycle fully conforms with the respective requirements of each class of electric assisted bicycle when operated in that mode. See Utah Code 41-6a-102
- Project: means an improvement, facility, property, or appurtenance to property that a local entity is permitted under law to own or acquire, whether located inside or outside the local entity's boundary, including:
(8)(a) a public building or other structure of any kind; and(8)(b) a joint or partial interest in the improvement, facility, property, or appurtenance to property. See Utah Code 17D-2-102- Property: means all of a person's right, title, and interest, both legal and equitable, in real and personal property, tangible and intangible, wherever located and however acquired. See Utah Code 78B-21-102
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Railroad: means a carrier of persons or property upon cars operated on stationary rails. See Utah Code 41-6a-102
- Railroad sign or signal: means a sign, signal, or device erected by authority of a public body or official or by a railroad and intended to give notice of the presence of railroad tracks or the approach of a railroad train. See Utah Code 41-6a-102
- Railroad train: means a locomotive propelled by any form of energy, coupled with or operated without cars, and operated upon rails. See Utah Code 41-6a-102
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- real property: includes :
(31)(a) land;(31)(b) a tenement;(31)(c) a hereditament;(31)(d) a water right;(31)(e) a possessory right; and(31)(f) a claim. See Utah Code 68-3-12.5- Receiver: means a person appointed by the court as the court's agent, and subject to the court's direction, to take possession of, manage, and, if authorized by this chapter or court order, transfer, sell, lease, license, exchange, collect, or otherwise dispose of receivership property. See Utah Code 78B-21-102
- Receivership: means a proceeding in which a receiver is appointed. See Utah Code 78B-21-102
- Receivership property: means the property of an owner that is described in the order appointing a receiver or a subsequent order. See Utah Code 78B-21-102
- Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Utah Code 78B-11-102
- Record: means , when used as a noun, information that is inscribed on a tangible medium or that is stored on an electronic or other medium and is retrievable in perceivable form. See Utah Code 78B-21-102
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Rents: means :
(18)(a) sums payable for the right to possess or occupy, or for the actual possession or occupation of, real property of another person;(18)(b) sums payable to a mortgagor under a policy of rental-interruption insurance covering real property;(18)(c) claims arising out of a default in the payment of sums payable for the right to possess or occupy real property of another person;(18)(d) sums payable to terminate an agreement to possess or occupy real property of another person;(18)(e) sums payable to a mortgagor for payment or reimbursement of expenses incurred in owning, operating, and maintaining real property or constructing or installing improvements on real property; or(18)(f) other sums payable under an agreement relating to the real property of another person which constitute rents under law of the state other than this chapter. See Utah Code 78B-21-102- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Restored-modified vehicle: means the same as the term defined in Section
41-1a-102 . See Utah Code 41-6a-102- Right-of-way: means the right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under circumstances of direction, speed, and proximity that give rise to danger of collision unless one grants precedence to the other. See Utah Code 41-6a-102
- Road: includes :
(33)(a) a public bridge;(33)(b) a county way;(33)(c) a county road;(33)(d) a common road; and(33)(e) a state road. See Utah Code 68-3-12.5- Roadway: means that portion of highway improved, designed, or ordinarily used for vehicular travel. See Utah Code 41-6a-102
- Safety zone: means the area or space officially set apart within a roadway for the exclusive use of pedestrians and that is protected, marked, or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone. See Utah Code 41-6a-102
- School bus: means a motor vehicle that:
(66)(a)(i) complies with the color and identification requirements of the most recent edition of "Minimum Standards for School Buses"; and(66)(a)(ii) is used to transport school children to or from school or school activities. See Utah Code 41-6a-102- Screening: means a preliminary appraisal of a person:
(1)(i)(i) used to determine if the person is in need of:(1)(i)(i)(A) an assessment; or(1)(i)(i)(B) an educational series; and(1)(i)(ii) that is approved by the Division of Integrated Healthcare in accordance with Section26B-5-104 . See Utah Code 41-6a-501- Security agreement: means an agreement that creates or provides for a lien. See Utah Code 78B-21-102
- Semitrailer: means a vehicle with or without motive power:
(67)(a)(i) designed for carrying persons or property and for being drawn by a motor vehicle; and(67)(a)(ii) constructed so that some part of its weight and that of its load rests on or is carried by another vehicle. See Utah Code 41-6a-102- Serious bodily injury: means bodily injury that creates or causes:
(1)(j)(i) serious permanent disfigurement;(1)(j)(ii) protracted loss or impairment of the function of any bodily member or organ; or(1)(j)(iii) a substantial risk of death. See Utah Code 41-6a-501- Sex: means , in relation to an individual, the individual's biological sex, either male or female, at birth, according to distinct reproductive roles as manifested by:
(34)(a) sex and reproductive organ anatomy;(34)(b) chromosomal makeup; and(34)(c) endogenous hormone profiles. See Utah Code 68-3-12.5- Shoulder area: means :
(68)(a) that area of the hard-surfaced highway separated from the roadway by a pavement edge line as established in the current approved "Manual on Uniform Traffic Control Devices"; or(68)(b) that portion of the road contiguous to the roadway for accommodation of stopped vehicles, for emergency use, and for lateral support. See Utah Code 41-6a-102- Sidewalk: means that portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians. See Utah Code 41-6a-102
- Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
- Soft-surface trail: means a marked trail surfaced with sand, rock, or dirt that is designated for the use of a bicycle. See Utah Code 41-6a-102
- Solid rubber tire: means a tire of rubber or other resilient material that does not depend on compressed air for the support of the load. See Utah Code 41-6a-102
- standing: means the temporary halting of a vehicle, whether occupied or not, for the purpose of and while actually engaged in receiving or discharging passengers. See Utah Code 41-6a-102
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Statute: A law passed by a legislature.
- street-legal ATV: means an all-terrain type I vehicle, all-terrain type II vehicle, or all-terrain type III vehicle, that is modified to meet the requirements of Section
41-6a-1509 to operate on highways in the state in accordance with Section41-6a-1509 . See Utah Code 41-6a-102- Street-legal novel vehicle: means a vehicle registered as a novel vehicle under Section
41-27-201 that is modified to meet the requirements of Section41-6a-1509 to operate on highways in the state in accordance with with Section41-6a-1509 . See Utah Code 41-6a-102 v3- Subpoena: A command to a witness to appear and give testimony.
- Substance abuse treatment: means treatment obtained at a substance abuse program that is approved by the Division of Integrated Healthcare in accordance with Section
26B-5-104 . See Utah Code 41-6a-501- Substance abuse treatment program: means a state licensed substance abuse program. See Utah Code 41-6a-501
- Summons: Another word for subpoena used by the criminal justice system.
- Testify: Answer questions in court.
- Testify: means to make an oral statement under oath or affirmation. See Utah Code 68-3-12.5
- Tow truck motor carrier: means the same as that term is defined in Section
72-9-102 . See Utah Code 41-6a-102- Tow truck operator: means the same as that term is defined in Section

10-3c-102 . See Utah Code 68-3-12.5- Traffic: means pedestrians, ridden or herded animals, vehicles, and other conveyances either singly or together while using any highway for the purpose of travel. See Utah Code 41-6a-102
- Traffic signal preemption device: means an instrument or mechanism designed, intended, or used to interfere with the operation or cycle of a traffic-control signal. See Utah Code 41-6a-102
- Traffic-control device: means a sign, signal, marking, or device not inconsistent with this chapter placed or erected by a highway authority for the purpose of regulating, warning, or guiding traffic. See Utah Code 41-6a-102
- Traffic-control signal: means a device, whether manually, electrically, or mechanically operated, by which traffic is alternately directed to stop and permitted to proceed. See Utah Code 41-6a-102
- Trailer: means a vehicle with or without motive power designed for carrying persons or property and for being drawn by a motor vehicle and constructed so that no part of its weight rests upon the towing vehicle. See Utah Code 41-6a-102
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Truck: means a motor vehicle designed, used, or maintained primarily for the transportation of property. See Utah Code 41-6a-102
- Truck tractor: means a motor vehicle:
(84)(a) designed and used primarily for drawing other vehicles; and(84)(b) constructed to carry a part of the weight of the vehicle and load drawn by the truck tractor. See Utah Code 41-6a-102- Trustee: A person or institution holding and administering property in trust.
- Two-way left turn lane: means a lane:
(85)(a) provided for vehicle operators making left turns in either direction;(85)(b) that is not used for passing, overtaking, or through travel; and(85)(c) that has been indicated by a lane traffic-control device that may include lane markings. See Utah Code 41-6a-102- Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws.
