(1) A peace officer may not restrain a person by the application of a knee applying pressure to the neck or throat of a person.

- Council: means the Peace Officer Standards and Training Council created in Section
53-6-106 . See Utah Code 53-13-101 - Peace officer: means any officer certified in accordance with Title 53, Chapter 13, Peace Officer Classifications. See Utah Code 53-1-102
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5(2) A violation of this section shall be referred separately to the county or district attorney for review, and to the Peace Officer Standards and Training Council for investigation.(3) A violation of this section is a third degree felony.(4) If the violation results in:(4)(a) serious bodily injury or loss of consciousness, it is a second degree felony; or(4)(b) death, it is a first degree felony.
