(1) This chapter does not authorize a use of real property that is otherwise prohibited by:
Terms Used In Utah Code 57-25-106
- Environmental covenant: means a servitude arising under an environmental response project that imposes activity and use limitations. See Utah Code 57-25-102
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- real property: includes :(31)(a) land;(31)(b) a tenement;(31)(c) a hereditament;(31)(d) a water right;(31)(e) a possessory right; and(31)(f) a claim. See Utah Code 68-3-12.5(1)(a) a zoning law;(1)(b) law other than this chapter regulating use of real property; or(1)(c) a recorded instrument that has priority over the environmental covenant.
(2) An environmental covenant may prohibit or restrict uses of real property that are authorized by zoning or by law other than this chapter.
