(1) An inspector employed by a local regulator, state regulator, or compliance agency to enforce the codes shall:

- Contract: A legal written agreement that becomes binding when signed.
- Division: means the Division of Professional Licensing created in Section
58-1-103 . See Utah Code 58-1-102 - Licensee: includes any holder of a license, certificate, registration, permit, student card, or apprentice card authorized under this title. See Utah Code 58-1-102
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Unprofessional conduct: means the same as that term is defined in Subsection
58-1-501 (2). See Utah Code 58-1-102
(1)(a)
(1)(a)(i) meet minimum qualifications as established by the division in collaboration with the commission;
(1)(a)(ii) be certified by a nationally recognized organization which promulgates construction codes; or
(1)(a)(iii) pass an examination developed by the division in collaboration with the commission;
(1)(b) be currently licensed by the division as meeting those minimum qualifications; and
(1)(c) be subject to disciplinary or other action if the licensee engages in unlawful or unprofessional conduct.
(2) A local regulator, state regulator, or compliance agency may contract for the services of a licensed inspector not regularly employed by the regulator or agency.
(3) In accordance with Section 58-1-401 , the division may:
(3)(a) refuse to issue a license to an applicant;
(3)(b) refuse to renew the license of a licensee;
(3)(c) revoke, suspend, restrict, or place on probation the license of a licensee;
(3)(d) issue a public or private reprimand;
(3)(e) issue a citation to a licensee; and
(3)(f) issue a cease and desist order.
