(1) Subject to Subsection 64-13-21(1)(b), the department may contract with a private provider or another agency for the provision of care, treatment, and supervision of an offender committed to the care and custody of the department.
Terms Used In Utah Code 64-13-26
- Contract: A legal written agreement that becomes binding when signed.
- Department: means the Department of Corrections. See Utah Code 64-13-1
- Executive director: means the executive director of the Department of Corrections. See Utah Code 64-13-1
- Offender: means an individual who has been convicted of a crime for which the individual may be committed to the custody of the department and is at least one of the following:(13)(a) committed to the custody of the department;(13)(b) on probation; or(13)(c) on parole. See Utah Code 64-13-1(2)(2)(a) The department shall:(2)(a)(i) establish standards for the operation of the programs;(2)(a)(ii) establish standards under Section 64-13-25 regarding program standards; and(2)(a)(iii) annually review the programs for compliance.(2)(b) The reviews described in Subsection (2)(a) shall be classified as confidential internal working papers.(2)(c) Access to records regarding the reviews is available upon the discretion of the executive director or the governor, or upon court order.
